No person shall be permitted to be present in, loiter or make or create
unnecessary or unusual noises on any school grounds, including lawns, buildings,
playground areas or parking areas forming a part of or used in connection
with any school, in the Township of Hillside between the hours of 10:30 p.m.
and 6:30 a.m., unless such activities are part of a meeting or events scheduled
and specifically authorized by the Board of Education of the Township of Hillside
or the administration of the school.
Every member of the Police Department of the Township and/or other officials
charged with enforcement within the Township or by the Hillside Township Board
of Education are hereby authorized, empowered and directed to enforce this
article by arresting all persons who refuse to remove themselves after being
requested to do so from the said school grounds.
Any person who shall violate this article shall be subject, upon conviction,
to a fine of $250.
It shall be unlawful for any person over the age of 18 to assist, aid
abet, allow, permit, suffer or encourage a student to register or enroll in
the Township of Hillside school district where the student is ineligible to
attend.
It shall be unlawful for any person over the age of 18 to knowingly
permit his or her name, address or other residence designating a document
to be utilized in the registration or enrollment of any nonresident student
in the Township of Hillside school district.
Any person violating or failing to comply with the provision of this
article, upon conviction thereof, shall be sentenced to make restitution to
the Township of Hillside, Board of Education and pay a fine of $1,000. In
determining the amount of restitution, the Court shall include the amounts
incurred by the Township of Hillside Board of Education, including but not
limited to tuition costs, investigation expenses and attorney's fees.
The restitution to be ordered by the Township of Hillside Municipal
Court may be converted into a lien against the property of the offending party,
if the offending party is the owner of said property located in the Township
of Hillside. Upon the order of restitution made by the Township of Hillside
Municipal Court, such liens shall be certified to the Township Tax Collector
by the Chief Financial Officer of the Township of Hillside.
