No person shall operate any motorboat or powerboat upon any
waters within or bounding the Township, whether driven by motor or
engine built into such boat or by what is commonly termed and known
as an "outboard" or "detachable motor," unless there is a muffler
on the motor or engine to prevent loud or obnoxious noises. The muffler
shall be used while the motor or engine is in operation.
No person shall operate any motorboat or powerboat upon any
waters within or bounding the Township, propelled or driven by a motor
or engine built in such boat, commonly known as an "inboard motor,"
of a horsepower greater than 10 horsepower, S.A.E. rating. This section
shall not apply to boats used for police or municipal work.
No person shall operate any motorboat or powerboat upon waters
within or bounding the Township, propelled or driven by a motor or
engine commonly known as an "outboard" or "detachable motor," of a
horsepower greater than 10 horsepower, O.B.C. rating. This section
shall not apply to boats used for police or municipal work.
No person shall, while riding in any boat, canoe or raft upon
any waters within or bounding the Township, make any loud or unnecessary
noise or use any profane, indecent or obscene language or by any quarreling,
shouting or otherwise disturb the public peace.
No person shall operate any motorboat or powerboat upon any
waters within or bounding the Township at a speed exceeding 10 miles
per hour.
A person may operate a motorboat or powerboat upon waters within
or bounding the Township only during the following periods of each
day:
A.
No
person shall operate any motorboat or boat propelled or driven by
a motor or engine commonly known as an "outboard" or "detachable motor"
upon those portions of the Ramapo River within the following described
areas:
(1)
Beginning at the northerly point of an island in the Ramapo River,
said point beginning 110 feet, more or less, southwest from the southwesterly
line of Lot 5, Block 624, as shown on the Tax Map of the Township,
and from said beginning point running thence southeasterly along the
northeasterly bank of said island, known as Lot 3, Block 616, as shown
on the Tax Map of the Township, to the southerly tip of said island;
thence southeasterly to the northerly tip of another island in the
Ramapo River, known as Lot 2, Block 616; thence southeasterly and
southerly along the easterly bank of said island to the southerly
tip thereof; thence southerly to the northerly tip of another island
in the Ramapo River, known as Lot 1, Block 616; thence southerly and
southwesterly along the easterly and southerly bank of said island
to the westerly tip thereof; thence westerly from the westerly tip
of said island to a point in the feeder dam; thence, southwesterly
along the feeder dam to the bank of the river; thence eastwardly and
northwardly along the easterly bank of the Ramapo River and the westerly
line of a 30-foot right-of-way of the Passaic County Park Commission
running along the easterly bank of the same Ramapo River, said right-of-way
formerly known as the old Morris Canal Tow Path, to a point where
the easterly bank of the Ramapo River intersects the northwesterly
line of Lot 5, Block 624 produced southwestwardly; thence southwestwardly
75 feet, more or less, to the northerly point of the first island
mentioned, being known as Lot 3, Block 616, and the point and place
of beginning.
(2)
Beginning at the westerly boundary line of the Township of Wayne
approximately in the center of the Ramapo River, being the point of
the intersection of the center of said river and the northerly line
of Lot 14, Block 626 prolonged westerly, and from said beginning point
running thence southerly along the westerly boundary line of the Township
of Wayne to the point of intersection of said line with the northerly
line of Lot 5, Block 624 prolonged southwesterly; thence northeasterly
along said prolongation of the northerly line of Lot 5, Block 624
to the easterly bank of the Ramapo River; thence northwesterly, northerly
and northeasterly along the easterly bank of the Ramapo River to the
point of intersection with the northerly line of Lot 14, Block 626;
thence northwesterly along a westerly prolongation of the northerly
line of said Lot 14, Block 626 to the westerly boundary line of the
Township of Wayne.
B.
No
person shall operate any motorboat or boat propelled or driven by
a motor or engine except within the normally existing channels or
banks of rivers or other permanent bodies of water and no person shall
operate such motorboat or motorboats on floodwaters outside the limits
of said channels or banks except for the performance of emergency
operations and except for the purpose of going to or from the property
owned by the operator of said boat or with the consent of the owner
of the property out of or to which the said boat is being driven or
operated.
C.
It
shall be unlawful for any person, notwithstanding any speed limit
fixed in this chapter for the normal operation of motorboats, to so
operate a motorboat as to cause floodwaters to wash against buildings
or structures or other property which may be damaged thereby.
