There shall continue to be three (3) Justices
of said Court and at the general election to be held in said City,
next preceding the close of the term of any Justice of said Court,
that office shall be filled by election, and the person so elected
shall hold office for the term of six (6) years from and after the
first day of January, next succeeding his election.
No person shall be eligible to the office of
Justice of said Court unless he shall be a resident elector of the
City of Albany, and unless he shall have been regularly admitted to
practice as an attorney at law in the Supreme Court of this state
at lease five (5) years previous to his election or his appointment
thereto to fill a vacancy.
Each of the Justices of said Court shall receive
such compensation as may be fixed and determined by the Board of Estimate
and Apportionment which may be increased by said Board from time to
time before or during the term of office of such Justices.
A vacancy occurring in the office of a Justice
of said Court, otherwise than by expiration of term, shall be filled
by appointment made by the Mayor of the City of Albany and the person
so appointed shall hold office until the expiration of the term for
which the Justice whose office has become vacant was elected.
The Justices of the Court or a majority of them
shall appoint the Clerk, stenographers, Marshals, secretary-librarian
and such other subordinates as the Board of Estimate and Apportionment
may from time to time prescribe.
