[HISTORY: Adopted by the Common Council of

It is the intent of the Common Council to relieve
the Traffic Court of the City of Albany of the administrative problems
in connection with the collection of fines for parking violation offenses
and to permit said Traffic Court to devote its time to traffic offenses
other than parking violations.
The Traffic Court of the City of Albany is hereby
authorized to establish a Parking Violations Bureau and to designate
the City Treasurer as the head of such Bureau and to transfer such
appropriate staff members presently assigned to the Traffic Court
to the jurisdiction of the City Treasurer, such staff members to be
budgeted on the payroll of the City Treasurer and deleted from the
budget of the Traffic Court.
A.
The Bureau so established shall be authorized to dispose
of parking violations only and to collect the fines presently designated
by the Court as penalties for parking violations over which the Bureau
has jurisdiction.
B.
Notwithstanding any provision herein, such Bureau
shall not be authorized to deprive a person from his right to counsel
or from his exercising his right to appear in Traffic Court.
C.
The Bureau shall establish and adopt comprehensive written policies
and procedures to govern and direct the processing and enforcement
of parking violations; such procedures shall include mechanisms to
periodically reconcile issued parking tickets to tickets paid, dismissed,
outstanding and voided.

D.
The Bureau
shall report to the Common Council quarterly the number of parking
tickets issued, paid, dismissed, outstanding and voided, and the value
thereof, within each calendar quarter.

Notwithstanding any other provision herein,
any person who shall have been, within the preceding twelve (12) months,
guilty of more than six (6) parking violations shall not be permitted
to appear in answer to a subsequent violation at the Parking Violations
Bureau but must appear in Court at a time specified by the Bureau.
Any ambiguity with respect to any provision
herein or interpretation hereof shall be governed by Article 14-B
of the General Municipal Law, as amended.
This local law shall take effect immediately.
