No person shall operate or permit to be operated in a zoning district, as defined in Chapter
307, Zoning, any device that produces a sound level exceeding the limitations in this Article
V. The measurement of any sound or noise shall be made with a sound-level meter using an A-scale decibel level. The measurement shall be conducted at the property line on which such noise is generated or perceived, whichever is appropriate in a residential district, or at the boundary lines of the receiving land use district.
Noise levels within any commercial/retail-zoned districts shall not exceed sixty-five (65) dB(A)'s and shall conform in all respects to the performance standards set forth in Chapter
307, Zoning.
No person shall conduct or permit to be conducted
construction activities in a manner so as to produce a sound level
exceeding the limitations in this section:
A. The use and operation of construction machinery and
equipment in connection with the excavation and filling of land and
the demolition, rehabilitation and construction of buildings between
the hours of 7:00 p.m. and 7:00 a.m., Monday through Friday, from
Friday 7:00 p.m. to Saturday 8:00 a.m. and all day Sunday and national
holidays, so as to be audible to the human ear beyond the property
line of the property upon which such excavation, filling, demolition,
rehabilitation or construction operations are being undertaken, provided
that this subsection shall not apply to operations of an emergency
nature undertaken by governmental entities or public service corporations
during the prohibited hours set forth above.

No person shall cause or permit the creation
of any unnecessary noise exceeding nonconstruction ambient noise levels
on any street, sidewalk or public place adjacent to any school, church,
senior citizen center or authorized day-care center while in use or
adjacent to any hospital at any time, provided that signs are displayed
so as to identify such zone.
