As used in this chapter, the following terms shall have the meanings indicated:
BLUFF
Any bank or cliff with a precipitous or rounded face adjoining a beach or a body of water. The seaward limit of a "bluff' is the landward limit of its contiguous beach. Where no beach is present, the seaward limit is mean low water. The landward limit is 25 feet landward of the "bluffs" receding edge.
BOND
A. 
MAINTENANCE BONDA personal bond executed by the owner or applicant, with security acceptable to the Town Board, furnished by the developer to guarantee workmanship, materials and maintenance of all required improvements for a period of one year from the date of release of the performance bond by the Town. If the required improvements are not accepted for dedication by the Town, this bond shall be continued until such acceptance, with an annual review as to sufficiency of the bond.
B. 
PERFORMANCE BONDA personal bond executed by the owner or applicant, with security acceptable to the Town Board, posted by the developer to ensure the completion of the public improvements in accordance with an estimate prepared by the Town Engineer and/or Superintendent of Highways.
CUL-DE-SAC
A short dead-end street terminating in a vehicular turnaround area.
EASEMENT
A restriction or grant established in a real estate deed to permit the use of private land by a public agency or a public utility for specified purposes or to protect some special quality of the private land for specified purposes, such as a scenic easement.
EASEMENT, LIMITED ACCESS
A restriction established in a real estate deed to control access from private land to public streets or other public areas.
FLAG LOT
A type of lot (commonly pole and flag-shaped in configuration) in which street frontage is provided by a strip of land which is narrow in relation to the remainder of the lot, which extends from the main body of the lot to the street, and which does not comply with the frontage requirements for the applicable zoning district. In addition, any lot that has, or is proposed to have, deeded access across a flag lot, shall be deemed to be a flag lot.

FLAG STRIP
The part of a flag lot which provides physical access from the lot to a street and which is narrow in relation to the rest of the lot.

LICENSED PROFESSIONAL ENGINEER OR SURVEYOR
A person licensed as a professional engineer or licensed as a land surveyor by the State of New York.
LOT
The unit or units, into which land is divided either as undeveloped or developed sites, regardless of how they are conveyed. "Lot" shall also mean "parcel," "plot," "site" or any similar term.
MEAN HIGH WATER
For each location, the nearest most recent determination by the National Oceanic and Atmospheric Administration (National Ocean Survey) and the listed elevation above mean low water as shown in their publications entitled "Tidal Bench Marks."
MEAN LOW WATER
For each location, the most recent determination by the National Oceanic and Atmospheric Administration (National Ocean Survey), and shall be 0.00 feet. All references shall be to the nearest listed tidal bench mark.
OFFICIAL MAP
The map established by the Town pursuant to law showing streets, highways, drainage, parks and preserves, both existing and proposed.
PARK DEDICATION
A dedication or reservation of land in a subdivision for park purposes, exclusive of lands to be used for drainage recharge.
PARK FEE
Money paid in lieu of park dedication to the Town of Shelter Island for use in the acquisition of Town parks.
PLANNED RESIDENTIAL DEVELOPMENT
A residential development of land based on an overall development plan approved by the Planning Board in accordance with the procedure established by resolution of the Town Board pursuant to Town Law § 281 in which the dimensional regulations and type of housing may be varied as provided in that resolution and where certain lands are set apart as permanent open space or common land.
PLANNING BOARD
The duly appointed Planning Board of the Town of Shelter Island.
PLAT
A. 
FINAL PLATThe map to be filed with the Planning Board and the County Clerk in the case of a major subdivision and with the Planning Board and the Town Clerk in the case of a minor subdivision, showing the final arrangement of lots, blocks, streets, drainage, parks and other anticipated improvements shown on the subdivision, if any.
B. 
PRELIMINARY PLATThe map prepared prior to the final plat for the guidance of the subdivider and the Planning Board, showing the arrangement of lots, blocks, streets, drainage, parks and other anticipated improvements shown on the subdivision, if any.
SKETCH PLAN
A pre-preliminary submission of a proposed subdivision, showing the information specified in § 111-10 of these regulations, to enable the subdivider to save time and expense in reaching general agreement with the Planning Board as to the form of the layout and objectives of these regulations.
STREETS AND HIGHWAYS
A. 
COLLECTOR STREETA street generally serving several subdivisions or a comparable rural area designed to have considerable continuity and to accommodate low to moderate speeds and low to medium traffic volumes and intended to channel traffic from local streets to highways.
B. 
HIGHWAYA highway, usually under the jurisdiction of the county or state, designed to have extensive continuity and to accommodate moderate speeds and moderately heavy traffic volumes and intended to connect important centers of development.
C. 
LOCAL STREET AA street, usually within a subdivision or subdivisions, designed to have considerable continuity and to accommodate low traffic volumes and intended to channel the traffic from other local streets to collector streets and highways.
D. 
LOCAL STREET BA street, usually within a subdivision, designed to have limited continuity and to accommodate low speeds and very low traffic volumes and intended solely to provide access to abutting properties within a limited area.
E. 
MARGINAL ROADA street within a subdivision, located on a separate right-of-way parallel and adjacent to a highway designed to provide access to abutting properties without interrupting highway traffic, except at widely spaced access points.
SUBDIVIDER
Any person, firm, corporation, partnership or association who shall lay out any subdivision or part thereof, as defined herein, either for himself or others, in which latter case their names shall also appear on the application for subdivision.
SUBDIVISION
The division of any parcel of land into two or more lots, blocks or sites, whether or not such division creates new streets or extends existing streets, and includes resubdivision, except that any division of land which creates no more than two lots and which is the direct result of a dimensional variance granted by the Board of Zoning Appeals shall not constitute a "subdivision" within the meaning of these Subdivision Regulations.
A. 
SUBDIVISION, MAJORAny tract of land which is hereafter divided into five or more parcels along an existing or proposed street, highway, easement or right-of-way for or as business, commercial or industrial lots or building plots, regardless of whether the lots or plots to be sold or offered for sale or leased for any period of time are described by metes and bounds or by reference to a map or survey of the property or by any other method of description.
B. 
SUBDIVISION, MINORIncludes all divisions of land whereby subsequent thereto there will exist two or more parcels, but less than a major subdivision.
SUPERINTENDENT OF HIGHWAYS
The duly elected Superintendent of Highways of the Town of Shelter Island.
TIDAL WETLAND
All those areas within the Town of Shelter Island customarily inundated at mean high water level tides, including intertidal salt marshes, which shall be presumed to be those areas upon which grow some, but not necessarily all, of the following: salt marsh grass (Spartina alterniflora), black grass (Juncus gerardi), salt meadows grass (Spartina patens), spikegrass (Distichlis spicata) and sand spurrey (Spergularia marina), and/or upon which exists salt marsh peat.
TOWN ATTORNEY
The Town Attorney of the Town of Shelter Island or any duly appointed counsel to the Town Board.
TOWN ENGINEER
A licensed professional engineer retained or employed by the Town of Shelter Island or by the Planning Board.
TOWN ENGINEER AND/OR SUPERINTENDENT OF HIGHWAYS
It is the intention of the Planning Board that the Town Engineer consult with and work in close cooperation with the Superintendent of Highways in making reports and recommendations pursuant to these regulations. It is anticipated that, as a result thereof, the Town Engineer and the Superintendent of Highways will generally be in agreement concerning matters to be determined pursuant to these regulations. Thus, these regulations frequently refer to "Town Engineer and/or Superintendent of Highways." In the event that the Town Engineer and Superintendent of Highways are unable to reach agreement on a particular matter, the term "Town Engineer and/or Superintendent of Highways" shall be interpreted as giving preference to the determination or recommendation of the Superintendent of Highways.
