The use of incinerators in multiple dwellings
is prohibited. Compactor equipment for the handling of garbage, rubbish,
refuse and other waste material shall be required in accordance with
the provisions of this article and applicable laws and regulations.
Every new structure arranged or intended to
be used as a multiple dwelling and every existing structure converted
to such use shall have constructed and installed in such structure
automatic compacting equipment capable of handling all garbage, rubbish
and refuse and other waste material, whether or not combustible, as
may be disposed of by the residents of such multiple dwelling. Said
compactor equipment shall be capable of accepting and reducing all
such garbage, rubbish, refuse and waste materials, at the rate of
at least 700 pounds per hour, to a compacted density of at least 300
pounds per cubic yard.
The required compactor equipment shall be of
sturdy and durable construction, designed to ensure safe, efficient,
trouble-free performance, and shall be designed, constructed, equipped
and operated to provide the following:
A.
The required compactor equipment shall be equipped
with a hopper or reduction chamber within which such garbage, rubbish,
refuse and waste material will be compacted. The interior of such
hopper or chamber shall be equipped with sufficient thermostatically
controlled sprinkler heads to be capable of extinguishing any fire
within such hopper or chamber and sufficient automatic sanitizing
or deodorizing devices capable of eliminating all odors and destroying
and preventing all vermin in the interior of such hopper or chamber.
B.
The required compactor equipment shall be capable
of automatically supplying, connecting or changing, loading, removing
and storing the containers into which the compacted material is deposited
in sufficient numbers to permit the automatic operation of such compactor
equipment for a period of 24 consecutive hours without manual maintenance.
C.
The required compactor equipment shall be capable
of being operated so as to deposit the compacted matter into sanitary,
waterproof, rodentproof and verminproof containers which can be completely
sealed and will not exceed 70 pounds in total weight when loaded with
compacted matter.
D.
The required compactor equipment shall be equipped
with adequate safety controls and devices capable of instantaneously
stopping the operation of such equipment both automatically and manually.
A.
The required compactor shall be constructed, installed,
operated and maintained in a separate room or compartment used for
no other purpose, separated from the rest of the structure by walls,
floor and ceiling having a three-hour fire-resistive rating and which
prevent the sound of the operation of such compactor equipment from
reaching the rest of the structure, and such room or compartment shall
be provided with a soundproof, self-closing fire door or doors having
a fire-resistive rating of at least one and one-half (1 1/2)
hours.
B.
Such room or compartment shall be equipped with sufficient
thermostatically controlled sprinkler heads to be capable of extinguishing
any fire in such room or compartment and sufficient floor drains properly
connected to a sanitary disposal system to receive and eliminate from
such room or compartment any water or other liquids from the operation
of the compactor equipment or the operation of such sprinkler heads.
C.
Such separate room or compartment shall be of sufficient
size and dimensions as to be capable of and appropriate for the storage
of at least that number of containers of compacted matter as would
result from a normal forty-eight-hour period of automatic compactor
operation.
D.
The walls, floor and ceiling of such separate room
or compartment shall be designed, constructed, finished and textured
to be capable of easy and efficient cleaning, sanitizing and deodorizing.
E.
Such room or compartment shall have an approved permanent
and continuous source of fresh air, in the form of fixed louvers or
similar approved devices, or, upon written approval of the Building
Inspector, such room or compartment shall be automatically mechanically
ventilated to the exterior of the structure so as to provide for at
least six complete changes of air in said room or compartment during
every hour.
F.
No such separate rooms or compartments for the required
compactor equipment shall open directly on any required means of egress,
elevator opening or public hallway unless such opening thereto is
cut off by a self-closing fire door having a fire-resistive rating
of at least one and one-half (1 1/2) hours.
A.
Structures in which compactor equipment is installed
pursuant to this section shall have installed therein sufficient chutes
or similar devices capable of accepting and delivering to the required
compactor equipment all waste matter disposed of by the residents
of such structure.
B.
Every such chute or device shall be straight in plumb
and shall have an inside diameter of at least 24 inches for its full
height.
C.
Every service opening of every chute or similar device
used in connection with and directly or indirectly feeding or depositing
any waste matter into the hopper or reduction chamber of compactor
equipment shall be equipped with a self-closing door or assembly having
a fire-resistive rating of at least one and one-half (1 1/2)
hours and shall be located in a room or compartment separated from
the rest of the structure by walls or partitions, floor and ceiling
having fire-resistive ratings of at least one and one-half (1 1/2)
hours.
D.
No room or compartment in which is located a service
opening into a chute or similar device shall open directly on any
required means of egress, elevator opening or public hallway unless
such opening thereto is cut off by a self-closing fire door having
a fire-resistive rating of at least one and one-half (1 1/2)
hours.
E.
Over every service opening into any chute or similar
device there shall be posted a conspicuous notice of a permanent nature,
approved by the Building Inspector, reading substantially as follows:

It is UNLAWFUL for any person to cause, permit
or allow carpet sweepings containing napthalene camphor balls and
flakes, floor scrapings, oil soaked rags, empty paint cans or any
other flammable or highly combustible substance to be thrown or deposited
into this opening, and such conduct is subject to a penalty.

F.
Every chute or similar device used in connection with
and directly or indirectly feeding or depositing the above waste matter
into the hopper or reduction chamber of compactor equipment shall
be equipped with sufficient thermostatically controlled sprinkler
heads to be capable of extinguishing any fire in such chute or device
and with an automatic sanitizing and deodorizing device capable of
eliminating all odors and destroying and preventing any vermin in
such chute or device.
G.
The interior of every chute or similar device shall
be provided with and shall be made of smooth-surfaced fireproof materials,
without any projections, capable of easy and efficient cleaning, sanitizing
and deodorizing.
Detailed plans and specifications for all required
compactor equipment and accessory or related equipment, assemblies,
chutes and devices shall be filed with and approved by the Building
Inspector before the same are installed, and failure to properly maintain
such installations in a safe and clean manner and condition shall
constitute a violation of this chapter.
The construction, installation, maintenance,
alteration, operation, repair, use, location, moving, removal, demolition
and any other work performed in connection with required compactor
equipment shall conform to, shall be done in compliance with and shall
be governed by the provisions of all laws, ordinances, rules and regulations
of the Incorporated Village of Thomaston and of all governmental bodies,
agencies and officials having jurisdiction thereof and, without limiting
the foregoing, all the provisions of this section regulating and governing
any specific type of work which is similar to the work to be performed
in connection with such compactor equipment; provided, however, that
where this section imposes a greater requirement or standard for such
work, such greater requirement or standard shall control.
Failure to comply with restrictions and requirements
regarding plans and specifications, approvals, permits, fees, inspections
and certificates made applicable under the above provisions to such
work in connection with the required compactor equipment shall be
an offense against the provisions of this chapter and shall be governed
by all the provisions of this chapter concerning appeals, violations,
enforcement and penalties.
