Editor's Note: This local law also repealed
former Art. V of Ch. 122 of the 1980 Code, Abandoned Handcarts, which
consisted of §§ 122-16, Abandonment prohibited; impoundment,
122-17, Redemption; fee, § 122-18, Sale of abandoned property;
proceeds, 122-19, Nonapplicability to motor vehicles, and 122-20,
Penalties for offenses.
The Village Board may from time to time by resolution
require the construction or repair of sidewalks along streets and
roads in the Village of Thomaston, as well as the construction of
sidewalks along state highways within the Village of Thomaston, and
the repair of sidewalks constructed by the state along state highways
in the Village of Thomaston, at the expense of the abutting owner
or owners or otherwise upon such notice and pursuant to the authority
or requirements of the Village Law of the State of New York, as amended.
No sidewalk, curb or gutter shall be constructed
or permitted to be constructed along any street, road or highway in
the Village of Thomaston unless such construction shall be in conformity
with all of the specifications and requirements established by rules
and regulations of the Board of Trustees.
All sidewalks, curbs, gutters or driveways constructed
on any privately owned street or highway of a new development shall
be subject to this chapter and shall comply in all respects with the
regulations applicable to streets, the title to which is vested in
the Village. Failure to comply with these requirements shall constitute
sufficient cause for the Village to reject any proffered dedication
of such streets.
No trees shall be planted within the sidewalk
area in front of or adjacent to any private premises, except trees
whose root systems normally will not cause damage to sidewalks, curbs
or utility installations. Trees of the following varieties only may
be planted: sugar maple (Acer saccharum), tree of heaven (Ailanthus),
northern red oak (Quercus borealis), scarlet oak (Quercus coccinea),
pin oak (Quercus palustris), American linden (Tilia Americana), silver
linden (Tilia tomentosa), moraine honey locust (Gleditsia tricanthos),
moraine flowering dogwood (Cornus florida), red flowering dogwood
(Cornus florida rubra), Japanese dogwood (Cornus kousa), goldenrain
(Koelreuteria paniculata), sourwood (Oxydendrum arboreum), easter
plane (Platanus orientalis) and flowering ash (Fraxinus ornus).
