A. No person shall tow, remove, impound or otherwise disturb any motor vehicle, other than an abandoned vehicle as defined in §
156-27 of this chapter, without permission of the vehicle owner, from privately owned property in the Village of Webster, other than property which is solely residential and contains fewer than five residential units, unless there is posted on the property, in a clearly conspicuous location at the entrance to the parking lot, a sign or notice conspicuous both day and night relating, in clear and concise English, and of a size at least 12 inches by 24 inches, with lettering at least 2 1/2 inches high and in a color contrasting to that of the background, that unauthorized vehicles will be removed at the vehicle owner's expense and providing the towing company's name, telephone number and address where towed vehicles may be retrieved. The towing company shall be responsible for assuring that signs meeting the requirements of this section are posted and maintained.
B. No person shall tow a vehicle from privately owned property in the
Village of Webster without permission of the vehicle owner to a location
2 1/2 miles from the four corners of the Village of Webster.

C. The towing company shall immediately notify the Webster Police Department
of all vehicles towed from a location within the Village of Webster
without permission of the vehicle owner and shall provide the Webster
Police Department with such information as the Police Chief may require.
D. The towing company shall notify the Village Board of Trustees at
the end of each month of all vehicles towed from a location within
the Village of Webster without permission of the vehicle owner.
E. No person shall place a parking boot on, or otherwise immobilize,
a vehicle owned by another person which is parked on private property.
F. Penalties for offenses. Violations of this section shall be as follows:
for first time offense: $75; for second offense: $175; for each offense
thereafter: $200.
G. Exemptions. The provisions of this section shall not apply to the
towing of a vehicle through the Village of Webster from a destination
outside of the Village of Webster to another destination outside of
the Village of Webster, nor to the towing of a vehicle from or to
a destination outside of the Village of Webster as long as said vehicle
is towed with permission of the vehicle owner by a towing company
without a place of business or storage lot in the Village of Webster.
After removal of any vehicle as provided in this article, the
Village Board, or its designee, may store or cause such vehicle to
be stored in a suitable place at the expense of the owner. Such owner
or person in charge of the vehicle may redeem the same upon payment
to the person with whom stored of the amount of all expenses actually
and necessarily incurred in effecting such removal and storage, such
storage charges not to exceed an amount per day or fraction thereof
as set by the Village Board.
It shall be the duty of the Village Board, or its designee,
to ascertain to the extent possible the owner of the vehicle or the
person having the same in charge and to notify that person of the
removal and disposition of such vehicle and of the amount which will
be required to redeem the same. The Village Board, or its designee,
shall also, without delay, report to the Village Clerk the removal
and disposition of any vehicle removed as provided in this article.
