From and after the approval of this article,
any person, firm or corporation engaged in the construction of sidewalks,
curbings and gutters for another person on any of the public streets
or alleys of the Borough of Columbia shall obtain from the Borough
Secretary/Treasurer of Columbia a sidewalk, curb and gutter contractor's
license, which license shall be for the period of one year from January
1 through December 31, at which time the license shall expire unless
sooner revoked.

The person, firm, corporation or other entity
desiring to obtain a sidewalk, curb and gutter contractor's license
shall, prior to the issuance of the license, file with the Borough
Secretary/Treasurer a bond, with good and sufficient surety, in an
amount equal to his/her/its estimated cost of construction, to be
approved by the Borough Solicitor, payable to the Borough of Columbia,
Pennsylvania, as a guarantee for the correct construction of every
piece of sidewalk, curb or gutter under his/her/its charge, in strict
accordance with the law, the ordinances, regulations and specifications
of the Borough and its proper officials; said bond to be for a period
of three years.

Prior to the construction of any sidewalk, curb
or gutter, a sidewalk, curb and gutter permit shall be obtained from
the Borough Secretary/Treasurer. The applicant for said sidewalk,
curb and gutter permit shall pay a fee as set from time to time by
resolution of the Borough Council. Should the replacement or repair
of asphalt become necessary, the applicant shall pay a fee as set
from time to time by resolution of the Borough Council. No construction
of any sidewalk, curb or gutter shall be undertaken until the proper
line and grade has been given by the Borough Engineer or other properly
designated official.

It shall be the duty of the Code Enforcement
Officer or other properly designated official to issue all sidewalk,
curb and gutter contractor licenses upon the filing of a properly
approved bond and to issue the sidewalk, curb and gutter permit upon
the payment of the proper fee and to keep an exact and accurate record
of all such licenses and permits issued.

Any person or persons violating any of the provisions
hereof shall, upon conviction thereof before any District Justice,
forfeit and pay to the Borough of Columbia, Pennsylvania, a fine of
not more than $600 for each offense, plus costs of prosecution, and,
in default of payment of such fine and costs, such person or persons
shall be subject to imprisonment for a term not exceeding 30 days.
Each day that the said violation continues after notice thereof shall
constitute a separate offense.
