As used in this article, the following terms
shall have the meanings indicated:
(As a noun) Material used to occupy excavation.
The Borough of Jim Thorpe.
Making opening and digging by hand or mechanical means.
Any person, persons, partnership, company or corporation
to whom permit to excavate or open Borough street or sidewalk is issued.
Shall include all work for excavation, trenching,
and backfilling for the installation, removal, repair and/or maintenance
of underground piping, conduit, or wiring, and the appurtenances thereof.
A.
Excavation materials shall include all substances
encountered in digging to permitted depth. Any such material not needed
for backfilling shall be removed from the site and taken to a permitted
dumping area.
B.
Excess excavation. If excavation is done below required
levels, the excess of excavation shall be backfilled with earth, sand,
gravel, modified concrete or such materials as may be acceptable to
the Borough Inspector and shall be thoroughly tamped and compacted.
C.
Excavation of rock shall include all stones larger
than one cubic foot, ledge rock or concrete that requires drilling
or blasting. Such excavation of rock shall be carried six inches below
bottom of pipe and/or other appurtenances.
D.
Excavated materials shall be protected at all times
to prevent nuisances by being blown or washed onto other premises.
E.
Water accumulation in excavations or opening at work
site shall be removed by pumping or by other means as approved by
the Borough.
F.
When soft, spongy, marshy, or swamp-like material
is encountered in or at the bottom of excavation, work shall immediately
cease and the Borough Inspector notified before resumption thereof.
B.
Manholes. Manholes and accessories thereto shall have
a maximum clearance of 24 inches on all sides.
C.
Bracing, sheathing, and shoring. Bracing, sheathing
and shoring necessary to protect all trenching shall be required as
directed by the Borough.
D.
Temporary bridges. Where it is necessary to maintain
traffic, foot or vehicular, the permittee shall build temporary bridges
or crossings across trenches or ditches as directed by the Borough.
E.
Trenches and excavated area. Shall be safeguarded
at all times by erection of pedestrian and vehicular barriers, caution
signs and warning lights when and where needed.
All pipes, lines, conduits and/or wiring shall
be examined, tested and approved by permittee in accordance with applicable
utility specifications.
A.
After pipes, lines, conduits and/or wiring and the
appurtenances thereof have been tested and approved as required herein,
backfilling shall be done with sand, 1B stone or modified subbase
materials placed evenly and carefully in two layers of six inches
each over, under and around the pipe and appurtenances thereof. Each
layer shall be thoroughly and carefully tamped so that one foot of
cover is in place over the pipe.
B.
The remainder of backfill materials, dry and free
of large lumps or stones, shall be placed in layers of not more than
eight inches, each thoroughly compacted with an approved mechanical
tamper.
C.
Each layer shall be compacted to density equal to
that of adjacent original material so that pavement can be placed
immediately.
D.
Puddling or water settling will not be permitted except
in special sand soil conditions where approved by Borough.
E.
Mud or wet materials, even if excavated from the site,
shall not be permitted for use in backfilling.
F.
Backfill material, from excavation or borrow shall
be dry, free from rooks, lumber and debris.
The final surface of streets shall be replaced
with the same number of inches of bituminous material as was removed
in excavation by permittee.
Permittee shall clean up and dispose or cause
the same to be done, of all excess materials, trash, forms, wood and
other debris.
No excavation nor backfilling shall be done
at any time except under the direction and supervision of an official
inspector appointed by the Borough. Such inspector shall enforce all
regulations relating hereto as required by this article.
