The Town Board of the Town of Woodstock hereby finds that the operation of skateboards, roller skates, in-line skates, passive scooters, coasters, roller skis, or any similar device on roadways, streets, sidewalks, or public property in the Town of Woodstock can be detrimental to the public health, safety and welfare of the people of the Town of Woodstock.
It is the intent of this chapter to regulate the operation of skateboards and similar devices as defined herein in the Town of Woodstock so as to protect the health, safety and welfare of the people of the Town of Woodstock.
This chapter is enacted pursuant to the provisions of Article IX of the New York State Constitution, § 10 of the New York Statute of Local Governments, § 10 of the Municipal Home Rule Law, § 130 of the New York State Town Law and other legislative authority of the State of New York as amended from time to time.
For the purposes of this chapter the following terms shall have the following meanings:
OPERATION
The act of riding or propelling a skateboard by any means other than carrying it.
OPERATOR
Any person operating a skateboard, whether its owner or another person.
ROADWAY
Any paved surface designed for use by motor vehicles, such as a street, road, driveway, highway, or parking area.
SIDEWALK
A hard-surfaced lane intended for pedestrian traffic.
SKATEBOARD
A board of any material with wheels affixed to the underside that may be ridden by a person. Regulations in this chapter applying to devices known by this name shall also apply to roller skates, in-line roller skates, passive scooters, coasters, roller skis, or any similar device, and use of this term in this chapter shall include such similar devices.
The following regulations shall apply to the operation of a skateboard on any roadway, street, sidewalk, or public property in the Town of Woodstock:
A. 
An operator of a skateboard shall be subject to all of the laws of the State of New York and of the Town of Woodstock applicable to drivers of motor vehicles and shall obey all official traffic control signals, signs, and other control devices applicable to vehicles.
B. 
On a sidewalk or in a crosswalk, except as otherwise specifically provided herein, an operator of a skateboard has the same rights and duties as a pedestrian.
C. 
It shall be a violation of this chapter to operate a skateboard in a manner that endangers any person or property or that causes damage to property or person.
It shall be a violation of this chapter to operate a skateboard in the following areas except between the hours of 6:30 p.m. and 10:00 p.m.:
A. 
Mill Hill Road and its sidewalks from the crosswalk at Maple Lane to the Village Green.
B. 
Rock City Road and its sidewalks from the Village Green to the entry of the municipal parking lot known as the "Bank Parking Lot."
C. 
Old Forge Road and its sidewalks.
D. 
Tinker Street and its sidewalks from the Village Green to the Tannery Brook Bridge at the intersection of Tannery Brook Road.
E. 
Tinker Street Two (the roadway between the Village Green and the Reformed Church) and its sidewalks.
F. 
All parts of the Village Green and its sidewalks.
A person convicted of a violation of any provision of this chapter shall be guilty of a violation, subject to the following penalties:
A. 
For the first conviction: a fine of not more than $25.
B. 
For the second conviction: a fine of not more than $50.
C. 
For the third conviction: a fine of not more than $75.
D. 
In addition to the above penalties, the court may impose community service or any other penalty or combination of penalties authorized by the Penal Law of the State of New York and/or the Criminal Procedure Law of the State of New York as a penalty for a violation.
