All land development activities shall be subject
to the following performance and design criteria:
A. Technical standards. For the purpose of this chapter,
the following documents shall serve as the official guides and specifications
for stormwater management. Stormwater management practices that are
designed and constructed in accordance with these technical documents
shall be presumed to meet the standards imposed by this chapter:
(1) The New York State Stormwater Management Design Manual
(New York State Department of Environmental Conservation, most current
version or its successor, hereafter referred to as the "Design Manual");
(2) New York Standards and Specifications for Erosion
and Sediment Control (Empire State Chapter of the Soil and Water Conservation
Society, 2004, most current version or its successor, hereafter referred
to as the "Erosion Control Manual");
(3) New York State Department of Environmental Conservation
"Instruction Manual for Stormwater Construction Permit";
(4) Best management practices established by Resolution
of the Town Board, which may be updated from time to time.
B. Water quality standards. Any land development activity
shall not cause an increase in turbidity that will result in substantial
visible contrast to natural conditions in surface waters of the State
of New York.

A. The Stormwater
Management Officer shall develop, implement and enforce a program
to reduce pollutants in stormwater runoff to the small MS4 from construction
activities that result in a land disturbance of greater than or equal
to 5,000 square feet within the New York City watershed area.
B. Standards.
At a minimum, the program must provide the equivalent protection to
the New York State Department of Environmental Conservation general
permit for stormwater discharges from construction activity and should
include the following standards:
(1) Requiring
erosion and sediment controls designed in accordance with the most
current version of the technical standards in the New York Standards
and Specification for Erosion and Sediment Control for all construction
activities that serve between 5,000 square feet and one acre of land.
(2) Inspections
shall be performed to insure compliance with this regulation.
C. Postconstruction
management. Projects of less than one acre which are within the New
York City watershed area that are part of a larger common plan of
development or sale shall be inspected postconstruction in accordance
with the most current version of the technical standards in the New
York State Stormwater Management Design Manual, including the enhanced
phosphorous removal of designed standards. The postconstruction stormwater
management controls are to be designed in accordance with the final
version of the enhanced phosphorous removal design standards by September
30, 2008.
D. Retrofit
programs. A program shall be established for identified areas that
are identified with erosion and/or pollutant loading problems. The
project will be based on the phosphorous reduction potential of the
specific retrofit being constructed/installed, the ability to use
standard proven technologies and the economic feasibility of constructing/installing
the retrofit.
