Annexation procedure — See Ch. 4.
Zoning — See Ch. 210.
Any application for annexation of territory contiguous to the corporate limits of the Town of Millsboro made by a property owner or a group of property owners to the Town Council shall contain the following information:
A. 
Metes and bounds description of the property to be annexed.

A recent survey plot of the property, including identification of that part to be annexed, if not the entire parcel.

C. 
A statement of reasons for requesting annexation and the grounds in support thereof.
D. 
A petition fee payable to the Town of Millsboro in such amount as is determined by the Town Council necessary to cover all expenses of annexation, including but not limited to the preparation of reports by its consulting engineer, publication costs and the preparation of any documents.
E. 
A certified list of all property owners located in the territory requested to be annexed.
F. 
The signature of each property owner filing the petition for annexation duly acknowledged.
G. 
If any applicant is a partnership, the names and addresses of the individuals composing the partnership, including all limited partners.
H. 
[1]If any applicant is a limited liability company, the names and addresses of the individuals composing the company.

I. 
If any applicant is a corporation, the name and address of each stockholder owning more than 10% of the stock of the corporation, the name and address of each officer and the name and address of each member of the Board of Directors or other governing body.

In addition to any public notice otherwise required as part of the annexation process, the Town Manager shall cause to be posted at one or more prominent and easily visible places on the property proposed to be annexed, on eighteen-inch-by-twenty-four-inch yellow cardboard, a public notice setting forth the date and time at which the Town Council has scheduled a public hearing on the annexation application, the name of the party who has requested annexation of property into the Town, the application number assigned to the annexation request (if any), a description of the property proposed to be annexed, and the zoning designation requested for the property proposed to be annexed. The notice shall also include Town Hall's address and telephone number for interested parties seeking further information on the public hearing and the proposed annexation. One such notice sign shall be posted for each street on which the subject property fronts. It shall be the responsibility of the party who has requested annexation, and not the responsibility of the Town, to maintain the notice signs in good condition during the posting period. Said notice sign or signs shall be posted at least 15 days prior to the public hearing and shall remain posted until the Town Council has taken a final action upon the requested annexation.
