It shall be unlawful to organize, conduct or engage in a parade or procession
upon any public street within the Town of Millsboro for which a permit has
not been obtained from the Town Manager as hereinafter provided.
Any person, association, organization or corporation desiring a permit as required by § 146-1 above shall make application, in writing, during regular business hours, not less than 72 hours in advance of the time and date for which the application is made to the Town Manager, setting forth the following information:
A.
The name and address of the applicant and/or the association
or corporation requesting the permit.
B.
The date on which the parade or procession is intended
to be held.
C.
The time the parade is to start and the time it is to
terminate.
D.
The route along which it is proposed such parade shall
be conducted.
E.
The estimated number of individual participants in the
parade or procession.
F.
The estimated number of vehicles to participate in the
parade or procession.
The Town Council, upon receipt of the written application containing the information required by § 146-2 above, shall grant the application, unless in order to prevent or avoid the creation of a public nuisance, undue disruption or congestion of traffic or menace to life, limb or property, in which the event the Town Council may deny the application or may modify the route to be followed or grant the permit for a different time or length of duration than that stated in the written application. No more than one permit shall be granted for a parade on any day. In the event that the Town Council refuses to grant a permit, the applicant may appeal to the Mayor who will have the power to issue or refuse the permit as he or she sees fit.

Whoever violates any provision of this chapter shall be deemed guilty
of a misdemeanor and, upon conviction therefor, shall be fined not less than
$25 nor more than $50 or imprisoned for a term of not more than 10 days, or
both, and shall pay the costs of prosecution and the town's reasonable attorney's
fees.

It shall be unlawful to conduct a booth for the purpose of sales of
any product, goods or services or to peddle any product, goods or services
before, during or after a parade or procession in the Town of Millsboro for
which a permit has not been obtained from the Town Manager as hereinafter
provided.
As used in this article, the following terms shall have the meanings
indicated:
Any person, association, organization or entity which intends to
or does establish a booth or peddle any product, goods or services or hand
out any written materials of any kind whatsoever.
Any person, association, organization or entity desiring a permit as
required by this article shall make application, in writing, during regular
business hours, not less than 72 hours in advance of the time and date of
the parade or procession for which the application is made, to the Town Manager,
setting forth the following information:
A.
The name, address, telephone number, fax number and e-mail
address of the applicant and the association, organization or entity requesting
the permit.
B.
The date on which the parade or procession is intended
to be held.
C.
The time the applicant is intending to begin and to terminate
his/her/its activities.
D.
The activity for which the permit is requested.
E.
The number of permits required by the applicant.
Fees for said permit shall be established by resolution of the Town
Council.
The Town Manager, upon receipt of the written application, containing
the information required by this article, shall grant the application, unless
in order to prevent or avoid the creation of a public nuisance, undue disruption
or congestion of traffic or a menace to life, limb or property, in which event
the Town Manager may deny the application or may modify the application or
grant the permit with conditions or modifications other than those stated
in the written application. Each and every person who shall participate with
the applicant shall have a permit. In the event that the Town Manager refuses
to grant a permit, the applicant may appeal to the Town Council.
A permit issued shall be displayed and in view at all times by the vendor
and all participants, employees and/or agents of the vendor by wearing said
permit, encased in plastic, around his/her/its neck.
