For the purposes of this chapter, the following
definitions shall be applicable unless the context clearly indicates
to the contrary:
Any property which has been conveyed to the Town of Millsboro
by a deed of record in the office of the Recorder of Deeds, in and
for Sussex County, and any property held by the Town of Millsboro
under a lease notwithstanding that such lease is not of record in
the office of the Recorder of Deeds, in and for Sussex County, and
any property over which the Town of Millsboro exercises control by
any agreement, oral or written.
A piece of wood or other material to which wheels are attached
and propelled by a human being.
Any boulevard, road, avenue, highway, alley, street, sidewalk
and any other public thoroughfare, including the sidewalks and shoulders
adjacent to any such public thoroughfare, located within the corporate
limits of the Town of Millsboro.
It shall be unlawful for any person to ride
or operate any skateboard on any street or on any public property
within the corporate limits of the Town of Millsboro.
A.Â
Games.
It shall be unlawful for any person to throw, kick or project in any
manner whatsoever in the streets of the Town of Millsboro any stone,
ball or other missile, including but not limited to the playing or
practicing of athletic games, quoits, pitching pennies, playing marbles
and like games.
B.Â
Objects
and obstructions. It shall be unlawful for any person to place, maintain
or permit any object or obstruction upon any part of any streets of
the Town of Millsboro; provided, however, that nothing herein shall
prohibit:
(1)Â
Placement
of any object upon any streets of the Town of Millsboro pursuant to
written permission first obtained from the Town of Millsboro in accordance
with standards and regulations established by Town ordinance or policy;
or
(2)Â
The
temporary placement of an object upon a street of the Town of Millsboro
during the process of loading, unloading, transporting or otherwise
moving such object from one place to another over, upon or across
such street.
Any person violating any of the provisions of
this chapter shall be deemed guilty of a misdemeanor and, upon conviction
by a court of competent jurisdiction, shall be fined for the first
offense not less than $5 nor more than $15 and shall pay the costs
of prosecution, and for the second and any subsequent offense shall
be fined not less than $10 nor more then $25 and shall pay the costs
of prosecution.
For the purpose of this chapter, each day or
part of a day that a violation occurs shall be deemed to be a separate
offense.
