Every application for a site plan review by the Planning Commission or a review or hearing before the Board of Adjustment shall be accompanied by a check payable to the Town of Millsboro for the following amount:
A. 
Site plan review. The fees for site plan review of residential, commercial and other types of applications shall be as set forth from time to time by the Town Council.

B. 
Inspection fees and performance guaranty.
(1) 
After site plan approval has been granted and prior to issuing of a building permit, the applicant shall tender to the Town of Millsboro a fee, in cash, in an amount to be established and from time to time revised by the Town Board. All inspection fees shall be determined in accordance with the prevailing hourly rate for such services, as specified in the current manual of information on consulting engineer services and fees, prepared by the Delaware Society of Professional Engineers, Inc.
(2) 
All of the improvements listed in § 210-45 shall be subject to inspection and approval by the Town who shall be notified by the applicant at least 48 hours prior to the start of construction. No underground installation, subgrade and/or stages of paving or other work done in stages shall be poured, covered, backfilled or removed until inspected and approved. Electrical and telephone utilities distribution supply lines are exempt from this inspection requirement.
(3) 
An occupancy permit shall not be issued until all the required improvements have been installed and approved in accordance with the provisions of this chapter or until a performance guaranty, acceptable to the Town Council, in a form approved by the Town Attorney, in an amount determined by the Town Engineer to be sufficient to assure completion of all the remaining improvement(s) and in a form guaranteeing completion of remaining improvement(s) within one year, is in hand.
C. 
Review hearing by Board of Adjustment. The fees for hearing and deciding appeals, special exceptions and hardship variances shall be as set forth from time to time by the Town Council.

If an applicant or the Town or the Board of Adjustment desires a certified court reporter, the cost of taking testimony and transcribing it and providing a copy of the transcript to the Town shall be at the expense of the applicant, who shall also arrange for the reporter's attendance.
