A Police Department be and the same is hereby
established in accordance with N.J.S.A. 40A:14-118 et seq. in and
for the City of Egg Harbor City, New Jersey, which may consist of
a Chief of Police, one or more Captains, one or more Lieutenants,
one or more Sergeants, one or more Corporals, one or more uniformed
patrol officers and one or more special police officers as to be determined
by the Common Council and appointed as hereinafter provided, who shall
exercise such duties and powers, other than civil duties, as are hereby
granted or may be conferred by law upon police officers and special
police officers of cities, and such police officers and special police
officers shall be subject to the provisions of this chapter and to
such rules and regulations as the Mayor and/or Director of Public
Safety may from time to time adopt.

The Mayor and/or Director of Public Safety shall
nominate and shall appoint the Chief of Police, one or more Captains,
one or more Lieutenants, one or more Sergeants, one or more Corporals
and all uniformed patrol officers, who shall severally hold their
respective offices and continue in their respective employment during
good behavior and efficiency in the City of Egg Harbor City.
Pursuant to N.J.S.A. 40A:14-146.8, the Mayor
may appoint special police officers for a term not exceeding one year
and may revoke such appointment without cause or hearing. Said special
police officers shall be subject to the provisions of this chapter
and to such rules and regulations as the Mayor and/or Director of
Public Safety may from time to time adopt and to the applicable provisions
of the statutes of the State of New Jersey.

The amount of compensation to be paid to the
Chief of Police, one or more Captains, one or more Lieutenants, one
or more Sergeants, one or more Corporals and to the uniformed patrol
officers shall be such sums as shall from time to time be fixed by
the general Salary Ordinance of the City of Egg Harbor City, which said salaries shall be payable at such times as
set forth in said general Salary Ordinance. The special police officers
shall receive no pay or compensation for their services as police
officers except when actually employed; and in the event of such employment,
the amount of compensation paid said special police officers shall
be at such rate as the Common Council shall, by resolution, provide.

The Chief of Police shall be the chief executive
officer of the Police Department, under the direction and supervision
of the Director of Public Safety. The Chief of Police shall obey and
shall cause the Captains, Lieutenants, Sergeants, Corporals uniformed
patrol officers and special police officers under him/her to obey
the provisions of this chapter and the rules and regulations of the
Police Department as may from time to time be adopted by the Mayor
and/or Director of Public Safety.

It shall be the duty of the Mayor of the City
of Egg Harbor City to cause the public peace to be preserved and see
that all laws and ordinances relating thereto are properly enforced.
Said Mayor shall faithfully and promptly obey and cause all the officers
under him/her to obey the rules, regulations and orders from time
to time prescribed by the Mayor and/or the Director of Public Safety.
The Mayor shall, in case of tumult, riot, insurrection or threatening
thereof, take command of the police force in person and direct their
movements and operations in the discharge of their respective duties.
Said Mayor shall also be present at all regular or special meetings
of the Common Council or be represented by a duly qualified member
of the Police Department.

Pursuant to the provisions of N.J.S.A. 40A:14-118
and N.J.S.A. 40A:61-1 et seq., the Mayor of the City of Egg Harbor
City is hereby appointed as the appropriate authority of the Police
Department of the City of Egg Harbor City.
All charges against members of the Police Department
shall be thoroughly examined into by the Mayor and/or the Director
of Public Safety in accordance with the provisions of the applicable
statutes of the State of New Jersey. Upon any member of said Department
being convicted by said Mayor and/or the Director of Public Safety
of any violation of this chapter or any of the rules, regulations
or orders governing the Department, the Mayor and/or the Director
of Public Safety may, in lieu of dismissal from the Department, impose
such other penalty as, in the judgment of the Mayor and/or the Director
of Public Safety, is warranted by the character and circumstances
of the offense.
When any member of the Police Department is
suspended from office and is afterwards reinstated, he/she shall not
receive any pay for the period of such suspension unless otherwise
ordered by the Mayor and/or the Director of Public Safety.
The governing body shall from time to time adopt
the rules and regulations that shall govern the Police Department
and the members of said Department. Each member of the Police Department
shall be presented with a printed copy of this chapter and of the
rules and regulations of the Police Department; such rules shall show
what his/her duty shall be on all occasions or upon his/her being
apprised of the violation of the provisions of any of the ordinances
of the city, and also what particular provision of any ordinance or
ordinances it is his/her duty to see enforced, and any neglect by
any members of the Police Department to carry out each and every rule
and regulation or order as aforesaid shall be held to be sufficient
cause for his/her dismissal from the Department.
The Mayor and/or the Director of Public Safety
shall maintain accurate records pertaining to law enforcement within
the city. Said records shall consist of those records required to
be maintained by all federal, state and county law enforcement organizations
and all applicable federal and state law and such other records that
shall assist the governing body in overseeing the control and daily
operations of the Police Department.

The furnishing of materials and supplies, proper
police quarters and necessary police paraphernalia, supervision of
the jail, control and maintenance of traffic lights and parking regulations
and other recommendations concerning the finances of the Police Department
shall be in charge of the Mayor of the City of Egg Harbor City. Said
Mayor of the City of Egg Harbor City shall make such recommendations
to the Safety Committee of the Common Council of the City of Egg Harbor
City as to all matters relating to budgetary and financial concerns
of said Police Department.
In the event of any conflict between a provision
of this chapter and the contract between the city and the Police Department,
the provisions of the contract shall prevail.
