There is hereby established a program for mandatory
separation of garbage, rubbish and refuse from recyclable materials
designated by township ordinance and for the disposal of garbage,
rubbish and refuse generated within the township and shall apply to
all property owners' tenants of such property and transients within
the Township of Logan.
For the purposes of this article, the following
words shall have the meanings respectively ascribed to them by this
section:
COMMERCIAL, INSTITUTIONAL, CONSTRUCTION, DEMOLITION, MANUFACTURING,
SPECIAL EVENT AND STREET VENDOR WASTE
Consisting of waste type 10, 13, 23, 25 and 27: Garbage,
rubbish and refuse including, but not limited to, food waste, rags,
ceramics, bulk furniture, bulk appliances, crockery, ashes, animal
and food processing wastes and dry industrial waste. It shall not
include hazardous wastes and/or medical/biohazard wastes.
HAZARDOUS WASTES
Includes, but is not limited to, motor oils, paints, paint
thinners/cleaners, insecticides, pesticides and any other items so
designated by the Federal or State Environmental Protection Agency
as to require special handling.
MEDICAL/BIOHAZARD WASTES
Includes, but is not limited to any solid waste which is
generated in the diagnosis, treatment (for example, provision of medical
services), or immunization of human beings or animals, in research
pertaining thereto, or in the production or testing of biologicals.
The term does not include any hazardous waste identified or listed
under 40 C.F.R. Part 261 or any household waste generated from home
self-care as defined in this section.
RESIDENTIAL WASTE
Consisting of waste types 10, 13 and 23: Garbage, rubbish
and refuse generated by households including, but not limited to,
food waste, rags, ceramics, bulk furniture, crockery, ashes. It shall
not include hazardous wastes and/or medical bio-hazardous wastes.
The owner, occupant, construction/demolition
contractor or proprietor/operator of special events shall collect
and store its garbage, rubbish and refuse in strict conformity with
the following regulations:
A. Residential households:
(1) All waste disposal containers must be stored in a
protected area or enclosure so as not to allow debris to blow onto
the streets or adjacent properties.
(2) All garbage, rubbish and refuse shall be placed in
waste disposal containers (trash cans, trash bags, dumpsters) and
secured so as to prevent easy access of vermin, pests and household
pets.
(3) No waste disposal containers shall be filled to the
point of overflowing.
(4) Hazardous wastes shall be disposed of separately,
according to federal (40 C.F.R. 261) or New Jersey Department of Environmental
Protection (N.J.A.C. 7:26-7) disposal regulations.
(5) Medical/biohazard wastes shall be disposed of separately
according to federal (40 C.F.R. 259) or New Jersey Department of Environmental
Protection (N.J.A.C. 7:26-3A) disposal regulations.
B. Commercial, institutional and manufacturing:
(1) All waste disposal containers must be stored in a
protected area or enclosure so as not to allow debris to blow onto
the streets or adjacent properties.
(2) All garbage, rubbish and refuse shall be placed in
waste disposal containers (tech cans, trash bags, dumpsters) and secured
so as to prevent easy access of vermin, pests or household pets.
(3) No waste disposal containers shall be filled to the
point of overflowing.
(4) Hazardous wastes shall be disposed of separately,
according to federal (40 C.F.R. 261) or New Jersey Department of Environment
Protection (N.J.A.C. 7:26-7) disposal regulations.
(5) Medical/biohazard wastes shall be disposed of separately
according to federal (40 C.F.R. 259) or New Jersey Department of Environmental
Protection (N.J.A.C. 7:26-3A) disposal regulations.
(6) Asbestos waste shall be disposed of separately according
to New Jersey Department of Environmental Protection (N.J.A.C. 7:26-2.12)
disposal regulations. Any other waste designated by New Jersey Department
of Environmental Protection shall be disposed of in accordance with
New Jersey Department of Environmental Protection regulations.
C. Common areas of shopping malls, strips or centers
and active retail commercially zoned areas:
(1) All waste disposal containers must be stored in a
protected area or enclosure so as not to allow debris to blow onto
the streets or adjacent properties.
(2) All garbage, rubbish and refuse shall be placed in
waste disposal containers (trash cans, trash bags, dumpsters) and
secured in a manner to prevent easy access of vermin, pests or household
pets.
(3) No waste disposal containers shall be filled to the
point of overflowing.
(4) No hazardous waste or medical/biohazard waste shall
be disposed of in common areas.
D. Buildings, parks, walkways and trails held out for
the use by the public including schools, government buildings, railroad
and bus stations, drive-in restaurants, self-service refreshment areas,
gasoline service stations, parking lots, campground and trailer parks,
marinas, boat moorage and fueling stations, boat launching areas,
public and private piers, beaches and bathing areas:
(1) All waste disposal containers must be stored in a
protected area or enclosure so as not to allow debris to blow onto
the streets or adjacent properties.
(2) All garbage, rubbish and refuse shall be placed in
waste disposal containers (trash cans, trash bags, dumpsters) and
secured so as to prevent easy access of vermin, and household pets.
(3) No waste disposal containers shall be filled to the
point of overflowing.
(4) Hazardous wastes shall be disposed of separately according
to federal (40 C.F.R. 261) or New Jersey Department of Environmental
Protection (N.J.A.C. 7:26-7) disposal regulations.
(5) Medical/biohazard wastes shall be disposed of separately
according to federal (40 C.F.R. 259) or New Jersey Department of Environmental
Protection (N.J.A.C. 7:26-3A) disposal regulations.
E. Construction and demolition projects:
(1) All waste disposal containers must be stored in a
protected area or enclosure so as not to allow debris to blow onto
the streets or adjacent properties.
(2) Debris or litter on or around construction sites shall
not be accumulated or stored in such a manner that it is likely to
be removed by natural forces onto adjacent property.
(3) All garbage, rubbish and refuse shall be placed in
waste disposal containers (trash cans, trash bags, dumpsters) and
secured in a manner so as to prevent easy access of vermin, pests
or household pets.
(4) No waste disposal containers shall be filled to the
point of overflowing.
(5) Hazardous wastes shall be disposed of separately according
to federal (40 C.F.R. 261) or New Jersey Department of Environmental
Protection (N.J.A.C. 7:26-7) disposal regulations.
F. Special events:
(1) All waste disposal containers must be stored in a
protected area or enclosure so as not to allow debris to blow onto
the streets or adjacent properties.
(2) All garbage, rubbish and refuse shall be placed in
waste disposal containers (trash cans, trash bags, dumpsters) and
secured in such a manner as to prevent the easy access of vermin,
pests or household pets.
(3) No waste disposal containers shall be filled to the
point of overflowing.
(4) Debris or litter on or around trash container shall
be accumulated or stored in such a manner that it is likely to be
removed by natural forces onto adjacent property.
(5) These containers shall be emptied or removed immediately
upon the completion of the special event. This shall include the scheduling
of a special collection so as not to exceed the capacity of an existing
container or enclosure.
(6) No hazardous waste or medical/biohazard waste be disposed
of in common areas.
The owner, occupant, contractor, proprietor
or sponsor of special events shall place their accumulated garbage,
rubbish and refuse for collection, remove and disposal in strict conformed
with the following regulations:
A. Residential households:
(1) All garbage, rubbish and refuse shall be placed at
the curbline nearest the residential dwelling for collection.
(2) Waste container(s) shall be place no earlier than
24 hours before the designated day of collection and removed from
the curbline no later than 24 hours following the designated day of
collection.
(3) Collection days shall be determined and coordinated
by the Township Recycling Coordinator.
B. Commercial, institutional establishments, shopping
malls/strips:
(1) All garbage, rubbish and refuse shall be placed in
a container/dumpster either rented, leased or owned by the establishment.
(2) Said container shall be located on the property of
the business for the use of that business. However, any commercial
or institutional establishment may enter into an agreement with another
establishment within its complex or building to share a trash container/dumpster.
(3) Owners, occupants, operators, managers or agents shall
arrange for separate collection, transportation and disposal, at their
expense, to the designated Gloucester County Solid Waste Disposal
Facility.
(4) Tenants of commercial, institutional establishments
and shopping malls/strips or centers may be exempt from collection;
transportation and disposal requirements set forth above if their
lease designates the owner responsible for this service.
C. Common areas of shopping malls or centers, active
retail/commercial zoned areas:
(1) The owner(s), operator(s), managers or agents of said
establishments or areas shall provide separately labeled trash and
recycling containers at a minimum of one set of containers every single
linear 1/4 mile (i.e., approximately 1,300 feet).
(2) The owner(s), operator(s), managers or agents shall
arrange for separate collection, transportation and disposal, at their
expense, of the trash to the designated Gloucester County Solid Waste
Disposal Facility.

a container/dumpster either rented, leased or owned by the establishment/contractor.
(2) Said container shall be located on the project site
for the exclusive use of that project.
(3) Owners, occupants, operators, managers shall arrange
for separate collection, transportation and disposal, at their expense,
to the designated Gloucester County Solid Waste Disposal Facility.
F. Special events.
(1) All garbage, rubbish and refuse shall be placed in
a container either rented, leased or owned by the establishment, proprietor
or sponsor.
(2) Said container shall be located at the event site
for the exclusive use of event participants.
(3) These containers shall be emptied or removed immediately
(not to exceed 24 hours) upon the completion of the special event.
(4) Owners, occupants, operators, managers, sponsors shall
be for separate collection, transportation and disposal, at their
expense, to the designated Gloucester County Solid Waste Disposal
Facility.

A. The
collection of garbage, rubbish, refuse and yard waste from the residential
households shall be performed by the Logan Township Department of
Public Works or such other party as may be designated.
B. Logan
Township Public Parks shall be cleaned and maintained by the Logan
Township Department of Public Works or such other party as may be
designated.
C. The
collection of garbage, rubbish, refuse and yard waste from all other
sources not mentioned above shall be the responsibility of the generator
and paid for by that source.

A. Residential
household waste containers shall be provided by the Township to the
occupant, owner or tenant of the property. Receptacles or containers
not provided by the Township shall not be subject to municipal collection
and the occupant, owner or tenant shall be responsible for their collection
and disposal.
B. Containers
used for commercial, institutional, construction, demolition or special
events shall be subject to the contractual agreement between the hauler
and the customer.
No person, firm, charity, corporation, partnership
or employee shall remove garbage, rubbish or refuse from Logan Township
for the purposes of disposing of the garbage, rubbish or refuse outside
of the Gloucester County Solid Waste Facility.
It shall be the responsibility of the Director
of Public Works and/or the Recycling Coordinator and/or the Clean
Community Coordinator and/or the Construction Officer and/or the Zoning
Officer and/or the Fire Marshal and/or the Police Department and their
designated agents to enforce all provisions of this article.

A. All persons, commercial, institutional and/or manufacturing establishments,
not in conformity with or in violation of this article shall, upon
conviction, be subject to punishment as follows:
(1) First offense: minimum of $50/maximum of $2,500 and/or up to five
days of community service.
(2) Second offense: minimum of $100/maximum of $5,000 and/or up to 10
days of community service.
(3) Third offense: minimum of $250/maximum of $7,500 and/or up to 30
days of community service.
(4) Subsequent offense: minimum of $500/maximum of $10,000 and/or up
to 60 days of community service.
