GENERAL REFERENCES
Vehicles and traffic — See Ch. 152.
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Includes any individual, partnership, association, corporation or joint-stock company, their lessees, trustees or receivers appointed by any court whatsoever.
STREET
Any street, avenue, park, parkway, highway or other public place.
TAXICAB
Any automobile or motorcar engaged in the business of carrying passengers for hire which is held out, announced or advertised to operate or run or which is operated or run over any of the streets or public highways of Logan Township, and particularly accepts and discharges such persons as may offer themselves for transportation from points or places to points or places within or without the township.
A. 
No taxicab shall be operated along any street in Logan Township unless and until the owner thereof shall obtain an owner's license from the township. An owner's taxicab license shall also permit the owner to drive and operate his taxicab(s) within the township without the necessity of obtaining an operator's license.
B. 
No taxicab shall be operated along any street in Logan Township unless and until the operator thereof shall first obtain an operator's license from the township.
Applications for owners' licenses and operators' licenses to operate taxicabs within the township shall be filed with the Township Clerk on forms supplied by the township in accordance with the procedures hereinafter set forth.
A. 
The annual license fee for an owner's license shall be $50 and such license shall expire on December 31 of each year, there being no pro rata reduction on applications being made during the calendar year. This license fee shall apply to each taxicab owned by an applicant for an owner's license.
B. 
The annual license fee for an operator's license shall be $10 and such license shall expire on December 31 of each year, there being no pro rata reduction on applications being made during the calendar year.
The Logan Township Council shall not consider any application for an owner's or operator's license unless and until the applicant shall first deposit the license fee with the Township Clerk and file with the Township Clerk an application requesting the appropriate license. Any application filed pursuant to this chapter shall include the following:
A. 
Proof of insurance as set forth in § 141-6.
B. 
A power of attorney wherein and whereby the owner of a taxicab shall appoint the Treasurer of the township his true and lawful attorney for the purpose of acknowledging service of any process out of a court of competent jurisdiction to be served against the insured by virtue of the indemnity granted under the insurance policy.
A. 
An original application for license under this chapter shall be accompanied by a certificate of public liability insurance reflecting the issuance of a policy by a company duly licensed to transact business under the insurance laws of the State of New Jersey providing for the following:
(1) 
Payment of a sum of $100,000 to satisfy all claims for damages by reason of bodily injury to or the death of any one person resulting from an accident.
(2) 
Payment of a sum of $300,000 to satisfy all claims for damages by reason of the bodily injuries to or the deaths of all persons resulting from an accident.
(3) 
Payment of a sum of $15,000 to satisfy all claims for damages to property of one or more persons resulting from an accident, on account of any such accident, by reason of the ownership, operation, maintenance or use of such taxicab upon any public street.
B. 
Any license granted pursuant to this chapter shall be valid only so long as the insurance policy shall remain in force to the full and collectible amounts as aforesaid.
C. 
The insurance policy shall provide for the payment of any final judgment recovered by any person on account of the ownership, maintenance or use of the taxicab or any fault in respect thereto and shall be for the benefit of every person suffering loss, damage or injury as aforesaid.
D. 
An applicant may fulfill the requirements of Subsection A of this section in accordance with N.J.S.A. 48:16-1 et seq., provided that coverage is at least comparable to that set forth in said Subsection A.
A. 
The Township Clerk, upon the filing of the required proof of insurance, shall issue a certificate in duplicate showing that the owner of the taxicab has complied with the terms and provisions of this chapter.
B. 
The certificate shall recite the name of the insurance company, the number and date of expiration of the policy, a description of the taxicab insured thereunder and the registration number of same.
C. 
The duplicate certificate shall be filed with the State Division of Motor Vehicles before any such vehicle is licensed as a taxicab.
D. 
The original certificate shall be posted in a conspicuous place within the taxicab.
The Township Council may establish additional rules and regulations relative to this chapter by resolution.
For purposes of enforcing this chapter, the members and officers of the Logan Township Police Department are designated as "enforcing officers." The members and officers of the Logan Township Police Department shall have the authority to enforce the provisions of this chapter and to make physical inspections of vehicles in connection with any application for a license hereunder.

Any person, firm or corporation violating any of the provisions of this chapter shall be subject to a fine not exceeding $1,000 or imprisonment in the county jail for a term not exceeding 90 days, in the discretion of the Judge before whom such conviction shall be had. Each and every violation and nonconformance of this chapter or each day that any provision of this chapter shall have been violated shall be construed as a separate and distinct violation thereof.
A license granted hereunder may be revoked by the Township Council, after notice and hearing, whenever it shall appear that the person to whom the license was granted has failed to furnish or keep in force the insurance policy and power of attorney required by this chapter or to comply with any terms or conditions imposed by the Township Council when the license is granted or any law of this state.
Nothing in this chapter shall exempt any person owning or operating any taxicab from complying with the laws relating to the ownership, registration and operation of motor vehicles in this state.
No license issued under this chapter is transferable, and the holder of the license shall be solely responsible for compliance with the provisions specified in this chapter.
