The following definitions and interpretations, for the purpose of application and enforcement within the meaning of this article, shall be as herein set forth unless another meaning is clearly apparent from the language or context thereof:
AUTOMOBILE TRAILER, MOBILE HOME, MODULAR HOME, HOUSE TRAILER, TRAILER COACH or TRAILER
A vehicle or structure so designed and constructed in such a manner as will permit occupancy thereof as sleeping or living quarters for one or more persons or the conduct of any business or profession, occupation or trade, or use as a selling or advertising device, and so designed that it is or may be mounted on wheels which may or may not be removable and used as a conveyance upon the highways, roads and streets or other thoroughfare, propelled or drawn by its own power or motivation or by other power or motivation, but shall specifically exclude any device which is used upon railroad tracks.
PERSON
Any individual human being, partnership, firm, association, corporation, tenant, owner, lessee and their agents, heirs or assigns.
TRAILER PARK, AUTOMOBILE TRAILER CAMP or CAMPSITE
Any park, trailer park, trailer court, campsite, lot, parcel of land or premises designed, maintained or intended for the purpose of supplying a location or accommodation for any trailer or trailer coach and upon which such a device may be parked, and includes all buildings used or intended for use as part of the equipment thereof. It shall not be necessary within this definition to determine whether or not a fee may or will be charged for the use of equipment or parking facilities. Unoccupied trailers offered for sale, display and inspection shall not be included within this definition.
A license shall be required for any person to conduct, operate, maintain or carry on the business of the operation of a trailer camp, trailer park or campsite, or work in, occupy or directly or indirectly in any manner whatsoever utilize any place or premises in which is conducted or carried on a trailer camp, trailer park or campsite. Such licenses may be granted by the Township Council of the Township of Logan in accordance with the terms of this article. It shall be unlawful for any person to conduct, operate, maintain or carry on any such business as herein described without first obtaining such license and paying the necessary fees as herein set forth.
Application for a license for the trailer park, automobile trailer camp or campsite shall be made upon request to the Township Clerk and upon forms approved and provided by the Township of Logan, which shall at a minimum contain the following information:
A. 
Full name and address of the applicant.
B. 
A description of the nature of the business intended to be carried on at the site.
C. 
Any trade name if the operation of the business shall be different from that of the owner.
D. 
A site plan shall be filed, clearly describing the lot or lots intended to be used as the location. The site plan shall contain all water, utilities and sanitary sewer systems, size of all pipes or piping and the location of all buildings and installations used or intended to be used. The site plan shall also include the location of any individual trailer site, all streets, curbing, walkways, buildings and installations to be used by occupants.
A. 
A license fee for a trailer camp or trailer park or campsite shall be paid in advance for each year and said license shall be issued for a period of one year commencing January 1 of each year. The purpose of said license fee is for the establishment of services for inspection, supervision, public health, general public welfare, fire, health, police protection and other governmental functions to be provided by the Township of Logan.
B. 
Each license issued per trailer park shall be open and conspicuously displayed in the principal office of the trailer park, trailer camp or campsite and shall be available at any time or times for public inspection of the same.
C. 
Each person to whom a license shall be issued under the terms of this article shall at all times maintain a camp registry on a monthly basis and shall submit one copy of the same on or before the 15th day of the month for the preceding month, setting forth the license number of each trailer upon the site, serial number of the same, body type, license number of any automobile, date of arrival, date of departure (if it has already left), the age of each person, together with the name and last permanent address of the owner of each car and trailer and of each occupant of any trailer site thereof. This copy of the camp registry information shall be delivered to the Township Clerk, together with the payment to the Tax Collector of any and all fees which may be due and owing to the township as provided for in this article.
Any license issued hereunder shall be issued to a specific person, as defined herein. No license shall be transferred or assigned without the express written consent and permission of the Township Council having first been obtained.
No license shall be issued for more than 100 trailers at any time. However, in the event a licensee has been in operation for a period in excess of one year and in the event that licensee has reached 75% of its licensed capacity, licensee may apply to the Township Council for an increase in its licensed capacity for up to 100 additional trailer sites. The Township Council, prior to the granting of any such approval, shall conduct a public hearing, which shall be advertised in a newspaper at least 10 days prior to the public hearing, and shall take into consideration the past operation of the licensed premises, including licensee's compliance with all regulations hereunder. The granting or denying of additional trailer sites shall also be taken under consideration by the Planning Board of the Township of Logan, and the Planning Board of the township shall make its recommendations known to the Mayor and Township Council.
A. 
Licensee shall submit, at least 45 days in advance of any Township Council meeting, its application for extension of licensed premises to the Planning Board of the Township of Logan, and shall submit in full detail the expansion so contemplated and shall, upon its application, include all of the criteria provided for under § 147-3 hereof. In addition to the criteria provided for under § 147-3, licensee shall for its expansion provide information relating to the following: privacy of individual trailer sites, pedestrian safety, adequate parking and sufficiency of recreational facilities.
B. 
The Planning Board of the Township of Logan shall submit its recommendations to the Township Council of the Township of Logan as soon as practicable. Thereafter, as soon as said application can be heard, Township Council will consider the recommendations of the Planning Board of the Township of Logan and shall hold its public hearing relating to the increase of said trailer license.
All electrical wiring, telephone wiring and any and all other wiring and utilities shall be located underground in any trailer park. Any connection to an automobile trailer, mobile home, house trailer, trailer coach or trailer, when referred to in this article, shall be made to all such underground sources; and no external wiring for any utility whatsoever shall be permitted to be above ground.
Applicant for a trailer park license shall submit three complete sets of engineering design plans and profiles of the proposed sanitary gravity collection system to the Township Clerk for review and approval of the Logan Township Municipal Utilities Authority.[1] The collection system shall be designed by a professional engineer licensed in the State of New Jersey and shall consist of a minimum size of eight-inch-diameter mains and forty-eight-inch-diameter manholes, designed in accordance with the rules and regulations of the New Jersey Department of Environmental Protection and the requirements of the Logan Township Municipal Utilities Authority. Ultimate treatment and/or disposal of the collected wastewater shall be as required by the Logan Township Municipal Utilities Authority and/or other county or state agencies and so noted on the plans. Additional and supplemental plans, specifications and information shall be submitted by the applicant as requested by the Township Clerk.

Applicants for licenses for camps, parks or campsites as hereinbefore referred to shall provide for private garbage and trash collection at such time or times as may be deemed sufficient to safeguard the health and safety of all occupants and of surrounding neighbors. Trash containers shall be placed at convenient locations throughout the trailer park, and such locations shall be clearly designated on the plans of application of any such applicant. Trash and garbage collection will be maintained at all times by the owner of said park.[1]

Recreation areas shall be designated on the plans and application of any proposed licensee. Such recreation areas may be defined as picnic, visitor parking, sports areas, pool areas, but nevertheless shall be clearly shown on the plans and application. Whenever such recreation area shall be shown on any plan, such plan shall also set forth the measurements of same.
A. 
Parking shall be provided by applicant/licensee in sufficient quantities to ensure that all parking shall be off-street, and shall be sufficient for all occupants of the trailer park and shall contain no less than the formula hereinafter set forth:
(1) 
Minimum requirements. Applicant/licensee shall provide no less than two parking spaces for each trailer site, each consisting of an area 10 feet by 20 feet and each marked and delineated with white lines or in other fashion necessary to clearly designate it as such, and the same shall be clearly accessible and available to automobiles.

(2) 
Visitor parking. There shall be at least one visitor parking area of the same dimensions as above set forth in Subsection A(1) for each trailer site.

B. 
Parking shall be clearly defined on such plans and specifications as shall be filed by the applicant seeking a license; and such trailer parking shall be spread throughout the applicant's park and designated on such layout in order to provide complete accessibility, convenience and safety to residents of the trailer park and their guests.
All camp cars, trailers, mobile units, house trailers, house coaches and trailers shall be required to register immediately upon entering or parking at any site, and payment of any fees shall be the responsibility of the owner of the trailer park. Books and records shall be made available to officers so designated by Township Council of the Township of Logan for examination of the books and records of any trailer park to determine the number of occupants and the number of trailer sites. Such books and records shall be available at any reasonable time or times upon reasonable request by Township Council of the Township of Logan.
The license fee for each mobile home, trailer, house trailer and trailer coach for purposes of this article is hereby established at $15 per month or any part thereof.
Each trailer site shall be provided with a minimum of 4,000 square feet of area and shall be no less than 50 feet by 80 feet. No more than one trailer, mobile home, trailer coach or house trailer may be parked on any individual site.
No disposal of waste shall be permitted on the ground, streets, parking areas or recreation areas of any trailer park. All waste shall be deposited in trash cans provided by licensee and placed in convenient locations to ensure the health and safety of all residents and visitors. All such receptacles shall be maintained in a clean and sanitary condition at all times by licensee. Licensee shall provide supervision and equipment sufficient to prevent littering of rubbish and debris.[1] Flytight metal depositories with tight-fitting metal covers shall be conveniently located throughout the trailer park in such numbers as shall be established to ensure the health and safety of the occupants of the area.

Licensee shall provide adequate illumination in the trailer camp. Any such lights shall be illuminated from 1/2 hour after sunset to 1/2 hour prior to sunrise. All electrical utilities shall be connected underground as herein set forth.
Licensee shall, in its initial application form, provide engineering plans, profiles and information relating to a storm drainage system designed by a professional engineer licensed in the State of New Jersey. The plans shall include: a stormwater runoff calculation plan; a plan showing the proposed surface grades, location of inlets, location and size of system pipes and pertinent elevations; profiles of the surface grades and stormwater system; details of appurtenances and any other information as required by the Township Engineer of the Township of Logan to ensure the safety and comfort of any residents.
Licensee shall provide an adequate supply of pure drinking water. All such water supplies shall be connected through underground sources to each trailer site. If private water supplies are intended to be used, such water shall be tested and inspected in accordance with all applicable state, county and local regulations. Licensee shall be responsible for all such testing.
No trailer shall be located closer than 10 feet to both the front and rear boundary lines of the space so allotted to each trailer. No trailer space shall be located closer than 10 feet to any property line bounding said trailer camp. No trailer shall be permitted to be inhabited by a greater number of occupants than that for which it was designed and constructed.
Licensee shall, in its initial application form, provide a plan showing the proposed roadway layout for circulation through the project. A typical roadway cross section shall be included. The roadway shall consist of a minimum of 24 feet wide of approved paving construction between concrete curbs. The applicant shall furnish any supplemental data as required by the Township Engineer of the Township of Logan to ensure the safety and comfort of any residents.
All motor vehicle parking areas are to be provided as follows:
A. 
Motor vehicles of residents, guests or visitors shall at all times be parked on a hard-surfaced lot, to be provided by licensee. No individual automobile or truck shall be permitted to be parked at any individual trailer site unless parked on a hard-surfaced base at such trailer area.
B. 
"Hard-surfaced" shall be defined under the terms of this article to be concrete, bituminous concrete or asphalt area of sufficient size and strength to be used for the purpose of parking motor vehicles.
All fuel containers used for the purpose of providing heat or cooking shall be enclosed and shall be placed at each trailer location in a manner to be approved by the licensee, to be located on an improved base consisting of concrete, bituminous concrete or asphalt and connected with copper tubing from said container to the interior of the trailers.
No person shall permit any such licensed premises to be used for immoral, illegal or unlawful purposes, or suffer the violation thereon or therein of any penal law of the State of New Jersey or of any ordinance of the Township of Logan.
Licensee shall comply with all police, fire, health or other rules and regulations which shall be imposed by the Township Council of the Township of Logan or of any of the duly authorized agencies of said township. Business premises of any such licensee shall be subject to examination and inspection at reasonable time or times when the Township Council, police, fire, health or other authorities or agents of the township so request.
A. 
All trailer parks in the Township of Logan shall provide and maintain the following minimum recreational area for the residents and guests of the trailer park in no less than the minimums as herein set forth:
(1) 
Four acres of recreation area for up to 100 trailers.
(2) 
One and five-tenths acres of additional recreational area for each additional 100 trailers or part thereof.
B. 
All recreation areas shall be located on usable land and shall not be located on land that from an engineering standpoint may be regarded as wasteland. Lakes, ponds, pools, tennis courts, shuffleboard courts and all other sporting facilities may be included in the makeup of any such recreation areas proposed.[1]

The Township Council of the Township of Logan is hereby empowered to revoke or suspend any license issued pursuant hereto if, after investigation and hearing, it shall determine that any licensee has violated the provisions of this article or that any trailer camp, trailer park or campsite has been maintained in an unsafe or unhealthy manner. In the event that any licensee shall refuse to comply with the terms and provisions of this article, the Township Council may, upon notice and hearing as hereinafter set forth, refuse to issue or may suspend or revoke any license applied for or granted under the terms of this article.
No license revocation or suspension shall be imposed by the Township Council until after public hearing is given to the licensee concerned. Notification shall be served upon any such offending licensee, setting forth the hearing date and specifications of said violation or violations, at least five days prior to the date set for any hearing. All notifications shall be in writing and may be filed with the Township Council, police, fire or health authorities of the Township of Logan. Upon such filing, a copy of the same shall be filed with the Clerk of the township for filing in the township records.

Any person convicted of any violation of this article shall be subject to a fine not exceeding $1,000 or imprisonment for a term not exceeding 90 days, or both, as the local Municipal Judge may determine. Each twenty-four-hour period of any violation shall be deemed to be a separate offense and punishable as aforesaid by a fine or imprisonment, or both.

As used in this article, the following terms shall have the meanings indicated:
TRAILER or CAMP CAR
Any vehicle, whether self-propelled or otherwise, used or maintained to be used as a conveyance upon the public streets or highways, and so designed, constructed, reconstructed or added to by means of accessories in such manner as to permit the occupancy thereof as a temporary or permanent dwelling or sleeping place, and having no foundation other than wheels, jacks or skirtings so arranged as to be integral with or portable by said trailer or camp car.
It shall be unlawful for any person to park any trailer or camp car on any street or road in the Township of Logan or on any premises within the limits of the Township of Logan, except for the purpose of making repairs or storage, for any period longer than six hours, and except as provided in § 147-32 hereof.

Any person who is now using a trailer or camp car within the Township of Logan for the purpose of a temporary or permanent dwelling, by sleeping or residing therein, may continue to do so, provided that a permit is secured for such trailer or camp car by making application therefor to the Township Clerk and by paying the required fee for such permit. The fee for such permit shall be $10, and said permit shall be good for a period of 30 days or until the first day of the next ensuing month, whichever date shall come first, or a permit may be purchased for a period of one year at a fee of $120. Any person permitted to make use of a trailer or camp car in Logan Township as provided herein shall always be in possession of a permit for the current month.

No person, except as provided in § 147-32 hereof, shall use any such trailer or camp car while parked within the limits of Logan Township as a dwelling or sleeping place.

Any person violating any of the provisions of this article shall, upon conviction, suffer and pay a fine not exceeding $1,000 or suffer imprisonment for a term not exceeding 90 days, or both.
