It is hereby determined that the great increase
in uncontrolled pigeons constitutes a menace to the public health
and is generally injurious to property within the City of Amsterdam.
As of 2023, due to the exponential increase in the migration of crows
within the City of Amsterdam, it has been determined that feeding
of crows within the City is a nuisance and a menace to the public
health and is generally injurious to property within the City of Amsterdam.

For the purpose of control and in order to alleviate
and prevent public distress and injury resulting from the menace caused
by uncontrolled pigeons, the Department of Health of said city is
hereby authorized and directed through the Department of Public Works
of said city to purchase traps and place them upon public buildings
or in public places and provide baiting of the same for the purpose
of trapping pigeons, in accordance with Environmental Conservation
Law § 11-0513 of the State of New York. The number, kind
and location of any such traps shall be determined by the Commissioner
of Health of said city.

Whenever any Antwerp or homing pigeon wearing
a ring or seamless leg band with its registered number stamped thereon,
or any protected wild bird within the meaning of § 11-0513
of the Environmental Conservation Law, is found among any such trapped
pigeons, they shall be immediately released from custody or placed
in care or charge of the Montgomery County Society for the Prevention
of Cruelty to Animals for disposal pursuant to law.

It shall be unlawful for any person to feed
any pigeon or crow in any public street or place.

The Commissioner of Health of said city is hereby
authorized to issue permits for the trapping of pigeons within said
city, in accordance with § 11-0513 of the Environmental
Conservation Law and subject to rules and regulations promulgated
by said Commissioner of Health. Any person seeking such a permit shall
file an application with the Commissioner of Health and shall include
in the application information as to type of traps to be used, location
of traps and a statement as to method of disposal of pigeons after
they have been trapped.

Except as otherwise provided for in the Environmental
Conservation Law, any person, firm or corporation who or which shall
violate any provisions of this article shall be liable to a fine of
not more than $250, imprisonment for not more than 15 days, or both
such fine and imprisonment.
