No person, firm or corporation conducting or maintaining any place of business on or along Market Street, Division Street, Guy Park Avenue and East Main Street in the City of Amsterdam, New York, which places of business are within the areas hereinafter set forth, shall keep, use, erect, construct or maintain any showcase, display counter, sales rack or sign in or upon the sidewalks on or along the respective streets, nor shall any property owners along said streets permit any tenant or occupant of such property to use, erect, construct, keep or maintain any such showcase, display counters, sales racks or signs in or upon the sidewalks on and along said streets hereafter set forth, which showcases, display counters, sales rack or sign shall project over and upon the sidewalks on and along the respective streets a greater distance than three feet from the face of the building in front of which the showcase, display counter, sales rack or sign is situated or located.
The provisions of this article shall apply to the following areas or portions of the above-mentioned streets, viz: Market Street, east and west side, from Guy Park Avenue to East Main Street; Division Street, north and south sides, from Market Street to Wall Street; Guy Park Avenue, from Market Street to Wall Street; East Main Street, north and south sides, from Market Street to Schuyler Street.
All showcases, display counters, sales racks or signs now in or upon the sidewalks on or along the streets and areas above set forth shall be immediately removed or made to comply with the terms of this article.
Any person, firm or corporation violating any of the provisions of this article shall be guilty of a misdemeanor punishable by a fine not exceeding $10, and in default of payment of such fine, the offender may be committed to the Montgomery County Jail for a period not exceeding one day for each dollar of such fine imposed. Each 24 hours such violation shall continue shall be deemed to constitute a separate offense.
