A. 
Penalties for parking violations.
(1) 
The penalties for the violation of the ordinances relating to any form of illegal parking shall be as follows:
(a) 
For the violation herein, a fine of $40 if the fine is paid within 48 hours of issuance of the violation notice.

(b) 
Upon failure to make payment after 48 hours from the issuance of the violation notice, the fine for violation of the ordinances shall be increased to $50.

(c) 
Upon failure to make payment after 96 hours from the issuance of the violation notice, the fine for violation of the ordinances shall be increased to $60.

(d) 
After court proceedings, if found guilty, the fine for violation of the ordinances shall be in an amount not to exceed $250.
(2) 
The above fines shall be applicable for each offense recorded on the parking summons.
(3) 
The fact that an automobile which is illegally parked is registered in the name of a person shall be considered prima facie proof that such person was in control of the automobile at the time of such parking.
(4) 
The Controller of the City of Amsterdam is hereby designated as the officer to receive moneys generated from violations of the sections of this chapter related to parking.
(5) 
In the calculation of the time period for paying the fines as set forth in Subsection A(1)(a), (b) and (c) of this section, Saturdays, Sundays and legal holidays recognized by the City of Amsterdam shall not be counted against violators.
B. 
Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a parking violation or a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than $100 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $200 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $300 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.
C. 
That a person parking in a space designated as parking for handicapped or permit who does not have a valid handicap/parking permit issued by the City Clerk personally to him or her shall be fined $100 for the first offense, $150 for the second offense and $200 for any subsequent offenses and such vehicle will be subject to tow.
