The purpose of this chapter is to authorize designated public
officers to issue and serve appearance tickets in connection with
any and all violations of this Code of the Village of Morrisville.
For purpose of conferring jurisdiction upon courts and officers
generally, unless otherwise specifically stated, any and all violations
of any and all provisions of this Code shall be deemed to be a violation
as defined in the Criminal Procedure Law, and for such jurisdictional
purpose only, all provisions of law relating to the prosecution of
violations shall apply to all such violations.
The Code Enforcement Officer, whether he holds the title of
Code Enforcement Officer or such other title as may be given by the
Board of Trustees, as well as any police officer or peace officer
and any and all other officer(s) as may be specifically authorized
by the Board of Trustees, is hereby authorized and empowered to enforce
all provisions of this Code, and to issue and serve appearance tickets
and such other process as may be required and/or authorized by this
Code or the Criminal Procedure Law in the course of such enforcement
proceedings. Any enforcement action or proceeding may be commenced
upon the personal knowledge of the Code Enforcement Officer or other
enforcement official, or upon the sworn statement of another individual
with first hand knowledge.
Unless otherwise specifically stated herein, any person, firm,
corporation, or other party or entity, whether owner, tenant, builder,
or contractor working on a subject lot or facility, who violates any
provision of this Code shall be considered guilty jointly and/or severally
of an offense against the health, safety, and welfare of the residents
of the Village and, upon conviction, shall be subject to a fine not
to exceed $250 plus costs or imprisonment not to exceed 15 days, or
both, for each violation. Each day that a violation continues shall
be deemed a separate offense and may be charged as such. The owner(s)
of property upon which a violation of these regulations has occurred
or is occurring shall be deemed vicariously liable for any and all
violations of this Code.
In addition to any other procedures herein provided and/or any
penalties herein provided, the Board of Trustees may seek injunctive
relief or other judicial relief to prevent the unlawful erection,
construction, alteration, use, or continued use of any facility or
lot, or to prevent the establishment or continuation of any activity
in violation of this Code.
Appearance tickets for all violations of this Code, with the
exception of parking tickets, shall be served personally, or by such
other means as may be authorized by Article 3 of the New York Civil
Practice Law and Rules.
If any section or provision of this chapter shall be held unconstitutional,
invalid, or ineffective, in whole or in part, such determination shall
not be deemed to affect, impair, or invalidate the remainder of this
chapter.
