It shall be unlawful for any person to erect or replace any container for the storage of fuel oil, gas, kerosene or other combustible liquid or gases above the surface of the ground, where such tanks or containers exceed three hundred (300) gallons in capacity, without obtaining a permit from the Village Board. A permit may be obtained from the Village Board upon the submission of a written application, the payment of any application fee determined by resolution of the Village Board and the holding of a public hearing by the Village Board upon not less than five (5) days' notice to the public.
Any person found guilty of a violation of this chapter shall be punishable by a fine of not exceeding two hundred fifty dollars ($250.) or by imprisonment not exceeding fifteen (15) days, or by both such fine and imprisonment.
