Before the issuance of a building permit to any potentially large user of water in the Town, as herein defined, or before the issuance of a building permit to a potentially large user of a sewage disposal system, either within or without the Town sewer districts, a review of the matter of water use or sewage disposal, or both, may be required by the Town Board, in which case no building permit shall issue until the Town Board has given its approval. No such Town Board approval shall be required where it is clear that the water supply and sewage disposal systems are entirely adequate, but in any case where the Supervisor or Building Inspector or Commissioner of Public Works shall, in his judgment, deem the adequacy of water supply and sewage disposal to be questionable and shall so certify to the Town Board, then the Town Board must review the matter and either approve or disapprove within 60 days.
For the purpose of this article, the terms used herein are defined as follows:
POTENTIALLY LARGE USER OF WATER SUPPLY OR SEWAGE DISPOSAL SYSTEM
Any townhouse development, apartment house, mobile home court, industrial or commercial establishment or any other potentially large user as determined by any of the officials mentioned in § 82-24.
In making its determination, the Town Board may require that studies be made, employing professional assistance, and if such studies are ordered, then the time within which the Board must render its decision may, in the discretion of the Board, be extended for a further period of 60 days. The Town Board, in its discretion, may order a public hearing in the matter and at such hearing may compel the attendance of witnesses by subpoena and may require that sworn testimony be taken.
When later circumstances shall warrant, the Town Board, in its discretion, may review any prior decision which refused issuance of a building permit.
The Town Board may determine as to any proposed building project located outside of the Town water and sewer districts that it is in the best interests of the public to require that the proposed building project connect into either a public water system or a public sewer system, or both, and may make such connection or connections a condition to the granting of a building permit.
