The Town Board of the Town of Wallkill has determined that incidents
involving the defacement of private and public property throughout the town
by vandals has increased, resulting in substantial damage to said property
and requiring action on behalf of the Town Board to deter and prevent such
activities to protect property owners in the town.
For purposes of this chapter, the following terms shall have the meanings
indicated:
The etching, painting, covering, drawing upon or otherwise
placing of a mark upon public or private property without the express permission
of the owner.
A.Â
No person shall make graffiti of any type on any building,
public or private, or any other property, real or personal, owned by any person,
firm or corporation or any public agency or instrumentality, without the express
permission of the owner or operator of said property.

In addition to those offenses or violations set forth
in the Penal Law of the State of New York, it is hereby determined that any
individual who has been found to have defaced property in the town by the
use of graffiti shall be determined to have committed a violation of this
chapter, which violation shall subject any such individual to a fine of up
to $500 and/or 10 days in jail and/or appropriate community service and/or
restitution to the owner of said damaged property.
Any individual furnishing information to the Town of Wallkill leading
to a conviction under this chapter shall be rewarded $200 for said information.
The name of any individual furnishing such information shall not be released.
It is hereby determined that the parents or legal guardian of any minor
found guilty of this chapter who are determined to have been on notice of
the propensities of said infant to commit said offense shall be liable to
the Town of Wallkill for a fine of up to $1,000.
