The Town Board of the Town of Wallkill hereby finds and determines that
it is the duty of the Town of Wallkill to provide for the safety and welfare
of all its residents. The Town Board further finds that the county-wide enhanced
emergency response system (E-911) affects said safety and welfare
of the residents of the Town of Wallkill, and an integral component of the
success of E-911 is the prominent and easily read display of the individual
property street address numbers.
A.
Every property owner within the Town of Wallkill is required
to display the appropriate E-911 property address number at the roadway in
front of said property, said number being no less than four inches in height,
legible in relation to its background and affixed to a mailbox or other type
of post.
B.
Every property owner is required to display the appropriate
E-911 property address number affixed to the main door of any building, residence,
or business, or affixed to the outside wall of same, facing said roadway,
said number being no less than four inches in height, unless more than 100
feet from said roadway, in which instance said number shall be no less than
six inches in height.
A.
This chapter shall be promulgated in the manner prescribed
by the laws of the State of New York and the Code of the Town of Wallkill.
B.
The Building Inspector of the Town of Wallkill and any
police officers within their jurisdiction within the Town of Wallkill shall
be charged with the enforcement of this chapter; said police officers are
authorized to issue appearance tickets for violation of this chapter.
A.
It shall be a violation for any property owner within
the Town of Wallkill subject to regulation under this chapter to fail to adhere
to the placement and size of said numbers as enumerated herein.
B.
Any person subject to this chapter who violates any provision
of said chapter, shall be issued a warning upon notice of the first instance
of violation for any specific property, but will be given 30 days in which
to correct said violation that has resulted in said warning, and upon a second
violation for any specific property shall be subject to a civil penalty not
to exceed $250.
Nothing in this chapter shall be construed to create a cause of action
by one person against another person for violation of any provision of this
chapter.
