The Board of Trustees has determined, in view of the fact that the Code
of the village has not been revised and recodified since 1964, that such Code
is presently in need of recodification and, further, that it is essential
to the good administration and government of the village and to proper law
enforcement to revise and recodify the Code of the village from time to time
to take account of changing conditions and to eliminate inconsistencies, inequities
and anachronisms and that it would be advisable to have a body of citizens
appointed to perform the task of reviewing the Code on an ongoing basis and
of making recommendations to the Board with respect to its modification and
generally of advising the Board with respect to local laws, present and proposed.
Accordingly, the Board of Trustees deems it appropriate to establish a permanent
Code Review Commission for the Village of Westbury for the benefit of the
health, safety and welfare of present and future inhabitants thereof and to
assist the Board in its legislative function.
Unless otherwise expressly provided, the following words, for the purpose
of this chapter, shall have the meanings herein indicated:
The Code of the Village of Westbury.
The Commission created by this chapter.
The Board hereby creates a Commission which shall be known as the "Westbury
Code Review Commission."
A.
The Board shall, by resolution, fix the number of members
of the Commission at a number not less than three nor more than five. Members
shall be appointed by the Mayor with the approval of the Board. The term of
office shall be three official years or until the member's successor
is appointed and qualifies, except that the members first appointed shall
be appointed for the official years expiring not more than one, two and three
years, respectively, subsequent to their appointments, and the term of one
member shall expire annually thereafter.
B.
Persons residing in the County of Nassau who are over
the age of 18 years and who are interested in the purposes of the Commission
shall be eligible for appointment as members of the Commission.

C.
Vacancies on the Commission shall be filled in the same
manner as the original appointment, except that a vacancy occurring other
than by expiration of term of office shall be filled only for the remainder
of the unexpired term.
D.
The Mayor, the Chairman of the Planning Board, the Village
Clerk, the Village Attorney and other officials of the village that may hereafter
be designated by the Mayor shall be ex officio members of the Commission.
The Mayor, with the approval of the Village Board, shall appoint one member of the Commission as Chairman at the annual organizational meeting of the Board each year for the ensuing year. At the first meeting of the Commission following each official year of the village, the Chairman of the Commission shall appoint a Vice Chairman and a Recording Secretary. The Commission shall adopt rules and procedures for the conduct of its meetings and business. It shall keep accurate records of its meetings and activities and shall file an annual report as provided in § 18-7 of this chapter. The Chairman of the Commission shall appoint committees thereof as deemed necessary.
The powers and duties of the Commission shall be:
A.
To examine the Code and any judicial decisions pertaining
thereto on a continuing basis for the purpose of discovering defects and anachronisms
therein and of recommending to the Board needed reforms.
B.
To receive and consider suggestions from judges, village
officials and department heads, the Village Attorney, other attorneys, residents
of the village and the public generally as to defects, anachronisms and needed
reforms in the Code.
C.
To recommend from time to time such changes in the Code
as the Commission deems necessary to modify or eliminate antiquated, inconsistent
or inequitable provisions of the Code and to bring the Code into harmony with
modern conditions.
D.
At the request of the Board of Trustees or the Village
Attorney, to draft, prepare and assist in the preparation of proposed local
laws effecting changes in the Code or parts thereof.
E.
To advise the Board of Trustees on the constitutionality,
consistency and effect of proposed local laws and to make examinations and
research respecting such proposed local laws when requested from time to time
by the Board of Trustees.
The Commission shall submit an annual report to the Board of Trustees,
not later than the first day of April of each year, concerning the activities
and work of the Commission and from time to time shall submit such other reports
and recommendations as may be necessary to fulfill the purposes of this chapter.
The members of the Commission shall receive as compensation for their
services as members the sum of $20 per meeting or such other compensation
as the Board may from time to time establish by resolution adopted at a regularly
scheduled public meeting.
The Commission shall submit annually to the Board a proposed budget
for official approval and ratification, and all expenses of the Commission
shall be paid from funds so appropriated.
