[HISTORY: Adopted by the Board of Trustees of the Village of Woodridge as indicated in article histories. Amendments noted where applicable.]
[Adopted 9-8-2020 by L.L. No. 3-2020[1]]
[1]
Editor's Note: This ordinance also superseded former Art. I, Acting Village Justice, adopted 11-5-2012 by L.L. No. 1-2012 (Ch. 21, Art. I, of the 1992 Code).
The Village of Woodridge is an incorporated Village within the Town of Fallsburg and the County of Sullivan, with a population of fewer than 3,000 residents, and desires to increase the area in which a Village Justice servicing the Village of Woodridge resides to include the Town of Fallsburg in accordance with the provisions of New York State Village Law § 3-300(2)(b). As an advocate for home rule, the Village Board's preference would be to have all Village elected officials reside within the Village limits, but the Board recognizes the challenge of finding interested candidates due to the population of the Village. As such, a Village Justice in the Village of Woodridge may reside anywhere within the Town of Fallsburg.
Only Village residents may vote in an election for Village Justice.
This article law shall take effect immediately upon filing with the Secretary of State.
[Adopted 9-21-2015 by L.L. No. 9-2015]
It is the intent of the Village Board of the Village of Woodridge to expand the number of potential appointees to various nonelected positions in the Village of Woodridge to residents of the Town of Fallsburg who might not otherwise reside in the Village of Woodridge in order to increase the number of qualified individuals who may be willing to serve in such positions. It is the sole intention of this article to expand the area in which a nonelected Village official may reside from the Village of Woodridge to the entire Town of Fallsburg, and is not intended to otherwise limit or reduce any other qualifications that may be required in order to hold an appointed office within the Village of Woodridge.
Notwithstanding any other provision of law to the contrary, a resident of the Town of Fallsburg, whether inside or outside of the Village of Woodridge, shall be eligible to serve as a nonelected, appointed Village official, including, but not limited to, the Village Clerk, Treasurer, Clerk/Treasurer, Acting Village Justice, and members of boards or commissions, including the Village of Woodridge Planning Board and the Village of Woodridge Zoning Board of Appeals.
