No person shall go in or upon the premises of the El Reno Cemetery located in the Northeast Quarter (NE 1/4) of Section 16, Township 12 North, Range 7 West of the Indian Meridian in Canadian County, Oklahoma, except between sunrise and one hour after sunset, except upon written permission granted by the Sexton of the cemetery or the desk sergeant at the City police station, which written permission shall state the date and time that it is effective. The provisions of this section shall not apply to employees of the City in the performance of their official duties.

A.
Horses in cemetery. No person shall permit a horse to go in or upon the El Reno Cemetery, except as provided in Subsection B hereof.
B.
Horseback riding in cemetery. No person shall ride
a horse in the El Reno Cemetery, including the roads, streets and
lanes therein, except in conjunction with a funeral service, and in
such event said horse or horses shall be confined to the roads, streets
and lanes therein.
C.
Offenses and penalty for violation. The violation
of this section shall be an offense, and any person convicted of such
violation shall be punished by a fine of not more than $50, including
costs, for each such offense.

A.
At least 25% of all monies received from the sale
of lots and interments shall be segregated and set aside as a permanent
fund to be known as the “Cemetery Care Fund.” The Cemetery
Care Fund principal shall be expended for purchasing lands for cemeteries
and for making capital improvements as defined in 11 O.S. § 17-110,
if necessary. The balance of the fund may be invested in the manner
provided by law for investment of municipal funds. The interest from
the investments shall be used for the same purposes as the principal
or in improving, caring for, and embellishing the lots, walks, drives,
parks and other necessary improvements on such cemeteries.

B.
All money received by the City from the sale of lots or from interments, or from any other source, shall be paid to the Municipal Treasurer, who shall deposit the same in the municipal treasury. Expenses incurred by reason of the upkeep, repair and adornment of the municipal cemetery may be paid by the Municipal Treasurer upon proper warrants authorized by the City Council and as further provided for in Subsection C.
C.
In respect to the Cemetery Care Fund, an amount equal
to the yearly anticipated interest and any unencumbered accumulated
earnings shall be budgeted yearly during the budget process.

A.
For the purpose of providing funds for the maintenance
of the cemetery of the City, a schedule of charges for the lots, interments,
perpetual care, and permits for activities affecting the cemetery
shall be set by Council in the form of a resolution.

All such charges shall be payable in advance.

A.
The Everlasting Care Fund is established for the purpose
of providing funds for the future maintenance of the cemetery of the
City El Reno when there are no additional revenues being deposited
from grave sales and it becomes necessary to provide some funding
for the El Reno Cemetery.
B.
The Everlasting Care Fund revenue shall be invested
by the Municipal Treasurer in the manner provided by 62 O.S. § 348.1
for the investment of municipal funds. The interest earned on the
Everlasting Care Fund shall also be deposited into this fund.
C.
The goal is to achieve a principal reserve balance
of $1,250,000, which shall remain intact.
D.
Only the principal above $1,250,000 and the actual
interest earned on the Everlasting Care Fund may be used for the future
care, maintenance, and improvement of the El Reno Cemetery, upon recommendation
of the Cemetery Board members, and submission to the City Council
for final approval.

Disposition of funds received: For each grave sold,
$100 shall be allocated to the Everlasting Care Fund, with the purpose
of creating a funding source for the future care and maintenance of
the El Reno Cemetery when all available grave spaces have been sold.

All such charges shall be payable in advance.
