There is hereby created a Recreation Commission which shall consist of 11 persons. The Board of School Directors of the Lancaster School District shall appoint three members to the Commission, two of whom shall be members of the School Board, and one shall be the School District's Business Manager or the person of similar function. These three members shall serve at the pleasure of the School District for an indefinite term. The Council shall appoint two members, both of whom shall be members of the Council. These two members shall serve at the pleasure of the Council for an indefinite term. The Mayor shall appoint one member who shall be the Director of Public Works or the person of similar function, and he/she shall serve at the pleasure of the Mayor for an indefinite term. The Council, upon recommendation of the Mayor, shall appoint three members, all of whom shall be residents of the City and none of whom shall be employees of the City, School District, Lancaster Township or Commission and none of whom shall be elected or appointed members of any other board, commission or agency, the members of which are elected or appointed by the City, School District or township. Each such member shall serve for a three-year term, expiring on December 31. Such members may be reappointed to the Commission and may be removed from office at any time for cause or at any time upon recommendation of the Mayor and approved by the Council. The Township Supervisors shall appoint two members of the Commission, one of whom shall be a Township Supervisor or a township employee. Such person shall serve as a member of the Commission at the pleasure of the Township Supervisors. The Township Supervisors shall also appoint one member, who shall be a resident of the township and not an employee of the City, School District, Township or Commission and not an elected or appointed member of any other board, commission or agency, the members of which are elected or appointed by the City, School District or township. Such member shall serve for a term of three years, expiring on December 31. Such member may be reappointed as a member of the Commission. Such member may be removed from office at any time for cause or at any time upon recommendation and approval of the Township Supervisors. In the event that a vacancy occurs for any reason, such vacancy shall be filled by the School District, the township, the Mayor and the Council, as shall be applicable. Any vacancy occurring in a term appointed by the Council, upon recommendation of the Mayor, shall be filled for the unexpired term. Any vacancy in a term of office originally appointed by the Township Supervisors shall be filled for the unexpired term of office.
The Recreation Commission shall be generally responsible for policies, rules and regulations relating to the administration of a public recreation program. The program, functions and powers of the Commission shall be those as delegated to the Commission by the Council and as otherwise permitted by law.
Immediately after the Recreation Commission's appointment, it shall meet and organize by electing one of its members President and by installing such other officers as may be necessary. The Commission shall have the powers to adopt bylaws, rules and regulations for the proper conduct of public recreation for the City.
The Recreation Commission shall provide, conduct and supervise public playgrounds, athletic fields, recreation centers and other recreation facilities and activities on any of the properties owned or controlled by the City, Lancaster Township and School District or on other properties with the consent of the owners and authorities thereof. It shall have the power to conduct any form of recreation activity that will employ the leisure time of the people in a constructive and wholesome manner.
The Recreation Commission shall be responsible to the cooperating agencies for hiring all employees, establishing salaries, control of the funds allotted, providing appropriate reports and preparation of an annual budget, which it will submit for approval to the City Administration, the Council, the township and the School District.
The Commission may also solicit or receive any gifts or bequests of money or other personal property or any donations to be applied, principal or income, for either temporary or permanent use for playgrounds or other recreational purposes.
The Commission shall have authority to levy fees and charges which it deems appropriate in providing recreational services or facilities.
The Recreation Commission is authorized to work jointly with other municipal departments and/or political subdivisions to provide and establish, operate, conduct and maintain a supervised recreation system and to acquire personal property and operate, improve and maintain property, both real and personal, for parks, playgrounds, recreation centers and other recreation facilities and activities.
