As used in this chapter, the following terms shall have the meanings
indicated:
PERSON
Includes corporations, partnerships and associations.
In any case where a person is required by ordinance to file a performance
or compliance bond with the city, conditioned for compliance with any ordinance,
such person may, in lieu of corporate surety which may be required by the
relevant ordinance or resolution, submit satisfactory and current evidence
of the following and give its own bond without corporate surety:
A. That there has been issued to such person a self-insurer
certificate by the Department of Revenue of the Commonwealth of Pennsylvania
under the provisions of Section 1434 of the Motor Vehicle Safety Responsibility
Act of 1959, April 29 (P.L. 58); or
B. That the Department of Labor and Industry of the Commonwealth
of Pennsylvania has issued an order exempting such person from insuring his
liability under the provisions of the Workmen's Compensation Act as last amended
by the Act of 1956, February 28, P.L. (1955), 1120, Section 1.
All ordinances requiring corporate surety on performance or compliance
bonds are amended by making the above provisions applicable thereto.
This chapter shall have no application to fidelity bonds.
