No person shall sell or expose for sale in any street or public place
in the city any newspaper, magazine or periodical without first obtaining
a newscarrier's license as provided in this Article.
The Chief of Police is hereby authorized to grant the license required
by this Article to any applicant.
All licenses granted under the provisions of this Article shall expire
on the last day of December in each year, provided that any license issued
in December of any year shall expire on the last day of December in the succeeding
year.
The Chief of Police, at his or her discretion, may require any applicant
for a license under the provisions of this Article to furnish evidence satisfactory
to him or her as to the good character of such applicant.
A record of all licenses granted under the provisions of this Article
shall be kept at police headquarters, which record shall contain the name,
age and residence of the licensee.
All licenses granted under the provisions of this Article shall be numbered.
Upon the issuing of any license under the provisions of this Article,
the Chief of Police shall furnish to the licensee a metal or other suitable
badge bearing a number corresponding with such license number, and the licensee
shall deposit with the Chief of Police the sum of twenty-five cents ($0.25)
for such badge.
All badges issued under the provisions of the preceding section shall
remain the property of the city. Upon the return of any such badge by the
person to whom it was issued, the Chief of Police shall refund to the person
so returning such badge the amount deposited for the same at the issuing of
the license. When any badge shall be returned before the expiration of the
license represented thereby, the Chief of Police, upon refunding the deposit
on such badge, shall cancel such license, except when such badge is taken
by the Chief during the suspension of any license.
Every licensee under this Article, while engaged in plying his or her
trade, shall wear the badge furnished under the provisions of this Article
upon the front of his or her hat or cap in such manner that it may be plainly
seen.
The Chief of Police may, at any time, for any cause which he or she
may deem sufficient, revoke any license granted under the provision of this
Article or may suspend the same for any period. No person shall engage in
any business covered by this Article after the revocation or suspension of
such license until a new license shall have been granted or such suspension
shall have expired. Whenever any such license shall be suspended, the Chief
of Police shall keep possession of the badge until such suspension shall be
removed. No license shall be granted to any person whose license shall have
been revoked during the year for which the license so revoked was originally
granted. Any suspension of a license may be continued from time to time at
the discretion of the Chief of Police.
No licensee under the provisions of this Article shall transfer or loan
his or her license or badge nor furnish any unlicensed person with any newspaper,
magazine or periodical to sell, nor permit any such unlicensed person to assist
or accompany him or her.
No licensee under the provisions of this Article, while engaged in plying
his or her trade, shall congregate with other persons, nor in any way annoy,
disturb or obstruct pedestrians or others in any public place, nor make any
unnecessary noise.
Every licensee under the provisions of this Article, while engaged in
plying his or her trade, shall obey the orders or instructions of any police
officer in relation to the manner of conducting himself or herself or his
or her business.

The selling, displaying for sale or distribution on any street or sidewalk
in the city of newspapers, magazines or periodicals is prohibited within seventy-five
(75) feet of street intersections.
