It is hereby declared necessary in the interest of public safety and welfare that the burning of yard waste, including grass, leaves and rubbish, and the setting of similar fires in the Village of Elm Grove be prohibited.
As used in this chapter, the following terms shall have the meanings indicated:
GRASS
Constitute grass, field, brush or similar combustible material in its natural state.
LEAVES
Constitutes fallen leaves, cut grass, lawn rakings, hedge trimming and similar debris accumulated in the course of yard maintenance.
PERSON
Includes individuals and businesses within the limits of the Village of Elm Grove but shall not be construed to include employees of the Village of Elm Grove while in the performance of their duties on behalf of the Village of Elm Grove.
RUBBISH
Constitutes all other combustible materials, including tree trunks and branches, but excluding similar materials and charcoal when properly contained in an outside grill and other cooking device or indoor or portable fireplace when used within the manufacturer's specifications.

No person shall burn grass, leaves or rubbish within the Village of Elm Grove except when the following conditions are met:
A. 
The purpose is to enhance native prairie biome.
B. 
A written burn plan for a parcel that contains a minimum of 10 acres is submitted to the Village Clerk.
C. 
Approval of the burn plan granted by the Fire Chief.
D. 
Approval of the Director of Public Works, the Village Manager, and the Board of Trustees.

Any person who shall violate any provision of this chapter or any rule or regulation made under this chapter shall be subject to a penalty as provided in § 1-16 of this Code.
