In order to preserve and protect the health, safety and welfare of the public, the Board of Trustees of the Village of Naples has deemed it necessary to prohibit the use of skateboards upon certain public sidewalks and streets within the Village of Naples and also upon the so-called Village parking lot owned by the Village of Naples and located at the intersections of Cross Street, Mill Street and Wall Street.
As used in this chapter, the following terms shall have the meanings indicated:
SIDEWALK
Any path or area, whether paved with asphalt or constructed of cement or concrete, at the side of a street and running generally parallel thereto and used principally for pedestrian traffic.
SKATEBOARD
Any device consisting of an oblong piece of wood or other materials mounted on two or more wheels.
STREET
A paved public thoroughfare used principally for vehicular traffic.
A. 
It shall be unlawful for any person to ride, push, propel or otherwise use a skateboard upon the following streets, sidewalks or areas within the Village of Naples:
(1) 
Upon the east sidewalk of Main Street from its point of intersection with the north line of Sprague Street to its point of intersection with the south line of Monier Street.
(2) 
Main Street from its point of intersection with the north line of Sprague Street to the point of intersection with the south line of Lyon Street.
(3) 
Upon the west sidewalk of Main Street from its intersection with the north line of Vine Street to its intersection with the south line of Lyon Street.
(4) 
Upon Mill Street or any sidewalk running parallel thereto from its intersection with the west line of Main Street to its point of intersection with the center line of Wall Street.
(5) 
Upon premises owned by the Village and presently used as a parking lot and bordered on the south by Cross Street, on the east by Mill Street and Wall Street, on the north by Vierhile and on the west by Peck.
B. 
Nothing herein shall be construed as prohibiting any person from securely carrying a skateboard while walking upon a street or sidewalk within the Village.

Any violation of any provision of § 292-3 of this chapter is hereby deemed a violation and shall be punishable as follows:
A. 
For the first offense by a fine of $25, and in addition the skateboard involved in such offense shall be confiscated by the Village of Naples and shall be returned to the owner upon payment of the fine.
B. 
For the second and all subsequent offenses by a fine of $50, and in addition the skateboard involved in such offense shall be confiscated by the Village of Naples and shall be returned to the owner 14 calendar days after the date of payment of the fine.
