No person shall use or operate a bicycle upon
any of the public roadways, sidewalks, or upon any path set aside
for the exclusive use of bicycles, or upon or in any other public
places or places open to the public in the Township, except in compliance
with the provisions of this chapter.
It shall be unlawful for the parent of any minor
to fail to exercise reasonable parental control over the minor which
results in the minor violating any section of this chapter.
Every person riding a bicycle upon a public
sidewalk or roadway, or upon or in other public places or places open
to the public, shall be granted all of the rights and shall be subject
to all of the duties applicable to the driver of a vehicle pursuant
to the traffic laws of the State of Michigan and the Township, except
as to special regulations set forth in this chapter and except as
to those provisions of said traffic laws which by their nature can
have no reasonable application to bicycle operation and use.
A.
A person operating, using or propelling a bicycle
shall not ride other than upon or astride a permanent and regular
seat attached thereto nor carry any other person upon such bicycle
other than upon a firmly attached and regular seat thereon.
B.
No person in the use and operation of a bicycle shall
carry more persons at one time than the number for which said bicycle
is designed and equipped.
C.
Every person operating or using a bicycle upon a public
roadway shall ride in single file as near to the right side of the
traveled pavement or other traveled surface of the roadway as is practicable,
exercising due care when passing a standing vehicle or one proceeding
in the same direction; and, whenever possible, such persons shall
ride on the shoulder of such roadway.
D.
Wherever usable paths for bicycles have been provided
adjacent to a roadway, bicycle riders shall use such paths and shall
not use the roadway.
E.
No person operating or using a bicycle upon a public
roadway shall pass between lines of traffic, but may pass on the left
of traffic moving in his direction in the case of a two-way street,
or on the left or right of traffic in the case of a one-way street,
in an unoccupied lane.
F.
Persons may operate or use bicycles on the sidewalks
in the Township, but such persons shall yield the right-of-way to
pedestrians and give audible signals before overtaking and passing
pedestrians.
G.
No person riding upon or operating any bicycle shall
attach the same or himself to any vehicle upon a public roadway. No
person operating a bicycle shall operate the same in other than the
normal manner for which the bicycle was designed.
A.
No person under the age of seven years shall operate
a bicycle upon any public roadway in the Township but such person
under seven years of age may operate a bicycle upon the public sidewalks,
private driveways, or upon or in other places or places open to the
public in the Township which are not utilized by vehicular traffic.
Persons between the ages of seven and 10 years may operate a bicycle
on all public roadways within the Township where the legal speed limit
is 25 miles per hour or less with parental consent, and may ride on
other public roadways when accompanied by another rider 18 years old
or older.
B.
No person shall operate a tricycle except upon sidewalks,
private driveways, and upon or in other public places or places open
to the public in the Township provided such places are not utilized
by vehicular traffic.
The Treasurer's office of the Township
is hereby authorized and directed to issue bicycle licenses which,
when issued, shall entitle the licensee, after securing a corresponding
registration card and a license sticker, to operate the bicycle for
which the license has been issued within the Township. The license
record shall be in three parts; one part to be filed with the Police
Department, one part to be given to the owner of the bicycle and one
part to be filed with the Township Treasurer's office. There
shall also be issued to the licensee a license sticker for the bicycle
which shall be numbered. The number shall correspond to the numbers
on the registration card and on the license. The Police Department
shall keep a register showing the date of issue, to whom issued, the
number of the sticker and any other pertinent information regarding
the bicycle licenses issued by the Township Treasurer's office.
The bicycle license sticker shall be attached upon the frame or rear
fender of the bicycle and the sticker shall remain in effect until
revoked. Whenever a sticker becomes illegible, it shall be replaced
by a new one. No person shall operate a bicycle within the Township
without a legible license sticker attached thereto.
It shall be the duty of every person who sells
or transfers ownership of any bicycle to report the sale or transfer
to the Police Department by returning the registration card to them
together with the name and address of the person or the persons to
whom the bicycle was sold or transferred within five days after such
sale or transfer. It shall be the duty and responsibility of the person
purchasing the bicycle or to whom a bicycle has been transferred to
apply for a new license of a bicycle within seven days after the sale
or transfer of the bicycle to said person.
No person shall willfully or maliciously remove,
destroy, mutilate or alter the number on the frame of any bicycle
license and no person shall remove, destroy, mutilate or alter any
license sticker or registration card during the time such sticker
or card is operative. The Police Department shall have the right to
stamp numbers upon the frames of bicycles upon which no number can
be found or on which the number is illegible or insufficient for the
purposes of identification of said bicycles.
The license fee for each bicycle license shall
be as established by the Township, a schedule of such fees being available
in the Township Treasurer's office.
