Article V Stopping, Standing and Parking

§ 266-50 Prohibited in specified locations.

No person shall stand or park, allow, permit or suffer any vehicle operated by him or registered in his name to stand or park in any street, highway, road or parkway under the control of the City in violation of any of the traffic rules and regulations of the City and in particular at any time in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or traffic sign or signal, and except in those areas where the installation and maintenance of parking meters have been approved by the Department of Highways of the commonwealth. Vehicles found violating any of the provisions of this section may be moved by or under the direction of a police officer and at the expense of the owner thereof to an approved storage area, and the expense and cost of such removing, towing and storage shall be the liability of the owner of the vehicle.

Within an intersection.

Upon any sidewalk.

Upon any crosswalk.

Upon any roadway where parking is permitted unless both wheels on the right side of the vehicle are within 12 inches of the curb or edge of the roadway, except upon those streets which are designated as one-way streets. On such one-way streets, vehicles shall be parked in the direction in which the vehicle is moving and with both wheels, front and rear, within 12 inches of the curb on the side of the roadway where parking is permitted. This shall not apply to streets or portions of streets where angle parking is required by these regulations.

Stopping, standing or parking, except on a one-way street, is permissible only on the right-hand side of the roadway in the direction in which the vehicle is facing.

Upon any roadway where the parking of a vehicle will not leave a clear and unobstructed lane at least 10 feet wide for passing traffic.

Upon any street or highway within 10 feet of a fire hydrant.

Upon any street or highway within 20 feet of an intersecting way, except alleys.

Within 15 feet of the exterior wall of a fire station or directly across the street from such station, provided that signs are erected acquainting the driver of such restriction.

On the roadway side of any vehicle stopped or parked at the edge of the curb of a street in such a manner as to constitute double line or multiple line parking.

Upon or in front of any private road or driveway without the consent of the owner or occupant of the private road or driveway.

No person shall park a vehicle other than a bus in a bus stop during the time that buses are in operation, except for the purpose of loading and unloading passengers therefrom and thereto, and no person shall stop or park a bus upon any street except close to the curbstone, or at a place other than a bus stop when a nearby authorized bus stop is available for use.

Upon any street or highway wherein the standing or parking of a vehicle has been prohibited and posted as a tow area by the Superintendent of Police, or his designee. Parking a motor vehicle upon or in front of or otherwise obstructing an alley or fire lane, or obstructing or parking a motor vehicle upon or in front of any private way so as to impede access by fire apparatus, shall be unlawful and subject to the punishment and/or other remedy as provided in this chapter or as otherwise provided by law.

No vehicle shall stop or stand within 75 feet of the traffic signal at the following locations:

(1)

Fletcher Street, both sides, from Thorndike Street to Dutton Street.

(2)

Fletcher Street, west side, from Dutton Street to Suffolk Street.

(3)

Suffolk Street, both sides, from a point 75 feet north of Fletcher Street to Fletcher Street.

Parking in violation of the residential parking permit area regulations set forth in Article VI of this chapter.

In any parking space designated "Handicapped Parking" unless the vehicle displays the special identification plate or placard authorized by MGL c. 90, § 2 or the official identification of a handicapped person issued by any other state or any Canadian province.

Parking or allowing to stand any motor vehicle and/or motor vehicle attachment (excluding recreational vehicles) having a gross vehicle weight of 12,000 pounds or more, or exceeding 24 feet in length, or having three or more axles, for more than 1/2 hour on any day, at any time, on any part of any street, way, highway or road under the control of the City of Lowell where parking or standing a vehicle is not otherwise prohibited, provided that this prohibition shall not apply during actual service or delivery or in the case of an emergency. Motor vehicles, regardless of size, owned or operated by the City of Lowell, the Commonwealth of Massachusetts, or the United States of America are hereby exempt from these regulations. Each day in which a motor vehicle is in violation of this provision shall constitute a separate offense.

In any parking space designated "Electric Vehicle Parking Only" unless the vehicle is connected for electric charging purposes.

In any parking space designated "Police Parking Only" or "Fire Department Only" unless it is an official Department vehicle or the private vehicle of a member of the Department currently on duty.

§ 266-55 Parking for handicapped persons; elderly drop-off zones. [1]

In accordance with MGL c. 40, § 22A, there is hereby established a fine of $300 for anyone who illegally parks a vehicle in a handicapped parking zone or who parks a vehicle in such a manner as to obstruct any curb ramp designed for use by handicapped persons.

The Superintendent of Police, his designee, or the City Clerk may issue a temporary handicapped parking permit to any person upon application with supporting medical affidavit signed by a licensed physician designating the applicant as physically handicapped. Said temporary permit shall be issued with an expiration date not to exceed 60 days from the date of issue and shall be displayed in the front right windshield of any vehicle parked in a designated handicapped parking space. The unauthorized use of a temporary permit shall be punishable by a fine of $50. Each day that any violation continues shall constitute a separate offense.

In order to accommodate the needs of handicapped persons, there are hereby set aside and reserved for persons having "V" or "HP" license plates, as well as temporary handicapped parking permits, the following parking spaces:

§ 266-61 Parking in front of certain entrances.

There shall be no parking in front of the entrances to any of the places and during the times enumerated in this section, and should any of such places be within a parking meter zone, the parking meters at the places and during the times enumerated in this section shall be hooded and rendered inoperative:

(1)

To a theater while any performance is being held therein.

(2)

To a funeral home while a wake or funeral service is being held therein. The following areas are designated as funeral home parking areas for a period of time beginning 1.5 hours before and ending 15 minutes after a wake or funeral service being held in a facility with frontage on this section of roadway, provided that proper signage is provided in accordance with current state DOT standards for the closure of a travel lane:

§ 266-62 Parking of commercial vehicles.

Except as provided in §§ 266-50 and 266-61, the operator of a commercial vehicle may stop or stand his vehicle in an area where parking is prohibited for the purpose of loading or unloading, delivering or collecting of goods, wares or merchandise to or from a person in the immediate vicinity of where his vehicle is stopped or standing for a period not to exceed 10 minutes, except that this exemption shall not apply if an officer directs such operator to move his vehicle.

§ 266-64 Taxicab stands.

No person shall park a vehicle other than a taxicab in an area designated by order of the City Council as a taxicab stand upon any public street, except that the operator of a private passenger vehicle may temporarily stop in any taxicab stand for the purpose of and while actually engaged in loading or unloading private passengers.

§ 266-65 Loading zones.

No person shall stop, stand or park a vehicle for any purpose or length of time, except as provided in Subsection B of this section, other than for expeditious unloading and delivery or pickup and loading of materials in any place marked as a curb loading zone during hours when the provisions applicable to such zones are in effect. In no case shall the stop for loading and unloading of materials exceed 30 minutes.

Loading zones shall be in effect Monday through Saturday from 8:00 a.m. to 6:00 p.m. only.

§ 266-66 Restricted use of certain streets.

Between the hours of 11:00 a.m. and 1:00 p.m. and between the hours of 4:30 p.m. and 6:00 p.m. on any street or highway which is hereafter designated as a restricted area, no person shall back his vehicle to the curb so that the same shall be headed in other than the line of travel, and no person shall deliver coal, ice, barrels, kegs or other heavy thing or things or collect the same for delivery to some other point, nor collect garbage, refuse or waste materials, nor clean out catch basins, nor open manholes, except in an emergency.

§ 266-67 Parking vehicle to display for sale.

It shall be unlawful for any person to park upon a street or highway any vehicle displayed for sale.

§ 266-68 Obstructing sidewalks.

No person shall unreasonably obstruct traveling on a sidewalk, and no person shall transfer merchandise from or to trucks or other vehicles over the sidewalk by use of planks or skids, except when such transfer is reasonably necessary, and provided that the sidewalk is not unreasonably obstructed and then only for such period of time as is necessary. Any police officer in uniform may order such planks or skids removed and if not removed immediately may cause the same to be removed.

§ 266-69 Repairing vehicles on public ways.

No person shall repair vehicles or other conveyances or cause them to be repaired in or upon any public way of the City, nor shall any person occupy any part of any public way as storage space for any vehicle, except that in an emergency temporary repairs may be made.

§ 266-71 Stopping or standing near schools.

No person shall stop or stand any vehicle upon any public way in the City within 500 feet of any school, public or private, in the City, on any day when schools are in session, for a period of time beginning 1/2 hour before the session begins and ending 1/2 hour after the session ends, for the purpose of selling or offering for sale any food, beverage or goods, wares or merchandise therein or therefrom.

This section shall not prevent the stopping of vehicles of hawkers or peddlers at dwelling houses within the areas described above and during the time mentioned above for the purpose of selling goods, wares and merchandise to occupants therein in accordance with the provisions of MGL c. 101 and regulations made under the authority thereof.[1]

§ 266-74 Storage parking or abandoned parking of motor vehicles.

No person shall park a vehicle in or upon any public way or a way or place in which the public has a right of access for a prolonged period of time so as to constitute storage parking or abandoned parking of a vehicle. A vehicle which has been so parked in excess of 72 hours after the same has been posted on the windshield thereof by a police officer shall be deemed to have been parked for storage or abandonment and shall be deemed to be in violation of this section and subject to a fine and other remedies as provided in § 266-132 and the sections following said § 266-132.

§ 266-75 Parking prohibited during street sweeping.

For the purpose of facilitating the sweeping and cleaning of streets during the period from April 1 to November 20, the parking of vehicles shall be prohibited on the odd-numbered side of the following streets or portions of said streets from 8:00 a.m. to 2:00 p.m. on the first Wednesday of each month and on the even-numbered side of said streets or portions of said streets from 8:00 a.m. to 2:00 p.m. on the first Thursday of each month:

Vehicles parked in violation of this section shall be subject to a ten-dollar fine. Vehicles in violation of this section may, upon the authority of a police officer, be further subject to be towed, and the owner of such vehicle shall be liable for such charges incurred for the removal and storage of the vehicle.

Signs stating said parking regulations shall be posted on said public ways as required by the Commonwealth of Massachusetts and as ordered by the Commissioner of Public Works of the City of Lowell.
