The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
HOUSEHOLD
A home, apartment or living quarters of a resident of a particular parking permit area of the City, as established by proof of real estate tax bill, lease, rental agreement, etc., but not including college dormitories, motels, hotels and other such transitory quarters.
PRINCIPALLY GARAGED
A vehicle that is registered under MGL c. 90 at an established address within a particular parking permit area of the City and on which vehicle a motor vehicle excise tax is paid to the City under the laws of the commonwealth.
RESIDENT
A person who resides within or owns a place of business within a particular parking permit area of the City at an established address therein.
The purpose of this article is to reduce hazardous traffic conditions within the City by the haphazard parking of vehicles in various areas within the City, including residential areas, and to:
A. 
Protect the various areas of the City from polluted air, excessive noise, and trash caused by the unregulated parking of such vehicles;
B. 
Protect the residents of the various areas from unreasonable burden in gaining access to their residences;
C. 
Preserve the character of the various residential areas;
D. 
Promote efficiency in the maintenance of the streets in the various areas in a clean and safe condition;
E. 
Preserve the value of the property in those various areas;
F. 
Preserve the safety of children and other pedestrians and traffic safety;
G. 
Ensure immediate access by public safety and emergency vehicles at all times; and
H. 
Preserve the peace, good order, comfort, convenience and welfare of the inhabitants of the City.

There are hereby established particular residential parking permit areas within the City. Parking of vehicles on the streets of a particular residential parking permit area is prohibited as herein prescribed except when the vehicle displays a particular area residential parking permit sticker or a particular area visitor parking sticker, affixed as established under this article.

A. 
Any resident of a particular residential parking permit area of the City whose vehicle is principally garaged within said area of the City shall be eligible to be issued an area residential parking permit sticker for such vehicle for said particular residential parking permit area.
B. 
Each household of a particular residential parking permit area of the City is eligible to be issued visitor parking permits to be affixed to the vehicle of guests or visitors of such household.
C. 
Area residential parking permit stickers and a visitor area parking permit shall be issued and administered by the City Parking Clerk at the City Hall.
D. 
Vehicles registered outside the commonwealth but operated by a student enrolled in a college or school within the City and on which vehicle a statement in compliance with MGL c. 90, § 3 has been issued by the Police Department of the City shall also be eligible to receive an area residential parking permit sticker, provided that such student is also a resident of the particular permit parking area of the City.
E. 
Area residential parking permit stickers shall be issued by the Parking Clerk in one or more colors designating thereby a particular residential parking permit area within the City. Residential parking permit stickers shall be affixed to vehicles as directed by the Parking Clerk.

There shall be no parking of any vehicle on the following streets, known as the "Pawtucketville residential parking area," during the hours of 7:00 a.m. to 10:00 p.m. (except Saturdays, Sundays and holidays) unless such vehicle displays a Pawtucketville residential parking sticker or visitor parking sticker for the Pawtucketville area attached to the vehicle as directed by the Parking Clerk:

A. 
The on-street parking of vehicles in the South End (Back Central Neighborhood), as that area is defined in § 266-85 of this chapter, as amended by ordinance passed on October 27, 1998, shall hereafter be on a first-come, first-served basis, and residential permit parking is hereby eliminated and is no longer applicable in said area. Nothing hereinafter shall alter or modify any currently existing normal parking regulations (e.g., parking only on one side of street, etc.) which remain in full force and effect in the area.
B. 
Reserved dwelling parking spaces, commonly referred to as "placard parking," in said South End (Back Central Neighborhood), which are provided for under § 266-85 of this chapter, as said section was amended by ordinance passed by the City Council on September 10, 2002, shall remain in effect in said area.
Parking in all other residential parking permit areas as may be hereafter established by the City Council shall be regulated as ordained by the Council.

A. 
Each single, two-family or multiple dwelling house with frontage on a street or way within the City of Lowell shall have one parking space on said street in front of said dwelling house reserved for the parking of a vehicle for use by the residents of said dwelling house. Said reserved parking spot shall be identified by the use of above-grade signs issued by the City of Lowell bearing the words "Parking Space Reserved for Residents of Dwelling."
B. 
Said signs shall be provided by the City of Lowell upon payment of applicable fees and shall be individually numbered.
C. 
Signs issued under this section shall expire on the last day of the month one year from the date of issuance of the sign unless renewed in accordance with any applicable procedures and fees. Said signs shall include provisions to affix a sticker or decal indicating the month and year of expiration.
D. 
Said signs shall reserve an on-street parallel parking space of standard width centered on the location of the sign and running 20 feet zero inches along the curbline or edge of the roadway.
E. 
Said signs may be located along any lot frontage, as defined in Article II of Chapter 290, of the property containing the dwelling house for whose residents the parking is reserved, provided that:
(1) 
Said signs are securely affixed to a fence, post, or other legal exterior location visible to motorists from the street or way and from the parking space designated by the sign. Signs may not be placed inside a building.
(2) 
The parking space designated as reserved under this section must be in a location where on-street parallel parking is legal under the General Laws of the Commonwealth of Massachusetts and this Code of Ordinances. The designation of a parking space as reserved under this section shall not supersede any other applicable section of this Code.
(3) 
Parking spaces designated as reserved under this section shall be located in such a manner as to maximize remaining unreserved public on-street parking available to other motorists.
(4) 
The property containing the dwelling house for whose residents the parking is reserved has at least 20 feet zero inches of legal lot frontage.
(5) 
No more than one parking space may be reserved for any individual parcel under the provisions of this section regardless of the number of buildings or dwelling units on the parcel or the number of streets or ways that the parcel has frontage on.
F. 
This section is applicable in all areas of the City, including residential permit parking areas.
G. 
A reserved dwelling parking space in the South End (Back Central Neighborhood) shall be permitted, and placard issued therefor, only if the dwelling house does not have:
(1) 
A driveway or other off-street parking area on the same property as the dwelling house to accommodate one or more vehicles; or
(2) 
Available leased, rented or owned off-site parking space(s) in the South End Back Central Neighborhood to accommodate one or more vehicles.
(a) 
If a dwelling house has parking space(s) as specified under Subsection G(1) or (2) above, no reserved dwelling parking space permits or placards shall be issued for such dwelling house.
H. 
Effective six months following the effective date of this amended section by the Lowell City Council, any issued and outstanding permits/placards for such dwelling houses which have reserved parking space(s) under § 266-85 prior to the effective date of this amended section shall be canceled and revoked. All holders of outstanding permits/placards issued under § 266-85 prior to the effective date of this amended section shall be entitled to obtain new signs subject to the requirements of this section. Notice of the amended section and requirements and the cancellation of outstanding permits/placards shall be sent via United States Mail to all permitholders whose addresses are on file in the office of the Building Commissioner within 30 days of the effective date of this amended section.
I. 
Parking in violation of this section shall constitute a violation of Article VI of this chapter of the Code and shall be subject to the fines and remedies imposed under § 266-86.
J. 
Fees for signs and decals or stickers under this section shall be charged as established by the Lowell City Council. Fees shall be established to cover the costs to produce the signs and stickers or decals and the costs to administer this section.

A. 
Parking without a valid residential parking permit sticker or visitor parking permit or otherwise in violation of this Article VI shall be punished by a fine of $25 for the first offense and $50 for the second and any subsequent offense. Vehicles parked in violation of this Article VI shall be subject to towing, removal and storage of said vehicle in accordance with MGL c. 266, § 120D, as amended.
B. 
Cancelled, revoked, expired or unauthorized parking signs: Display of a cancelled, revoked, expired, or unauthorized parking sign intended to restrict parking on a public street or way shall be penalized by a noncriminal disposition as provided in MGL c. 40, § 21D, and subject to a fine of $300. Unless otherwise specified, each day shall constitute a separate violation. Unless otherwise excluded by state or federal law, a police officer, code enforcement officer, local building official, zoning officer, or other official designated by the City Manager is empowered to enforce the provision of this subsection of this chapter.

A. 
Nothing in this article shall be deemed to be intended to waive any other powers and remedies available to the City to enforce applicable statutes, regulations, ordinances or this chapter pertaining to parking violations.
B. 
This article is passed in part pursuant to the provisions of MGL c. 90, § 20A and any other applicable statutes.
