This article is adopted for the purpose of promoting
the orderly and safe parking of motor vehicles and the minimizing
of traffic congestion on Borough-owned property located within and
generally bounded by Thomas Street, George Street, Main Street and
Stephen Street and known as Lot Nos. 4-1, 6-1 and 3, Block 151.
A.
The provisions, rules and regulations of this article
pertain solely to the premises hereinabove described which are owned,
leased, occupied or controlled by the Borough of South River and devoted
to the purpose of parking motor vehicles, but do not apply to any
land or area within the right-of-way of any public street, road or
highway, nor do they apply to any parking areas operated or controlled
by the South River Parking Authority.
B.
These provisions, rules and regulations shall not
be applicable to any other parcels of land and premises owned, leased,
occupied or controlled by the Borough of South River, now or hereafter.
A.
Parking on said lands and premises hereinbefore designated
shall be permitted by permit only, which shall be evidenced by a decal
issued to the owner of the motor vehicle.
B.
Such parking area shall be marked by signs indicating
that parking will be by permit only and that vehicles must bear the
required decal, which signs may state "Parking for Vehicles With Decals
Only."
C.
No vehicle shall be parked in any such parking area
unless it displays in the lower rear corner of its left rear window
a current and valid decal so issued by the Borough of South River
as herein provided.
D.
No vehicle shall be parked except within a single
designated parking space as shall be indicated within said parking
area or as may be directed by the police or attendant in charge of
the parking area or by a control sign indicating the designated area
to park.
E.
Trailers, trucks or buses shall only be parked in
any such parking area as may be specifically designated for the same.
F.
Visitors to public buildings, including the Borough
Hall, of the Borough of South River shall park their vehicles in two
parking spaces which shall be specifically set aside and clearly designated
in such parking area.
G.
All vehicles shall be parked in such area with the
front of the vehicle facing the control sign, if any, which designates
the parking space therefor.
H.
No vehicle shall be parked within the entrance or
exit to any such parking area or within any of the aisles thereof.
A.
Decals shall be issued by the Borough Clerk during
the regular hours during which his office is open and only upon display
of a current and valid New Jersey motor vehicle registration certificate
showing the name and address of the applicant as a resident of the
Borough of South River. Such decal shall be issued only to the owner
of the motor vehicle and shall not be transferable. However, a decal
may be transferred during the period of its validity to a new vehicle
or motor vehicle purchased by the applicant upon the sale or transfer
of the original vehicle. In such case of a sale or transfer, the owner
shall remove the decal and supply evidence thereof to the Borough
Clerk to obtain a new decal for transfer to a different vehicle.
B.
Decals shall be valid from February 1 of the year
in which issued to 12:00 midnight of January 31 of the following year.
C.
The application for a decal and permission to use
the same shall be at no charge to the applicant. Any person may obtain
a temporary decal good for one day. Further, no decal and no permits
shall be issued if the parking area shall already be at full capacity.
D.
The first decals issued following the adoption of
this article shall be valid from the date of issue until 12:00 midnight
of January 31, 1980.
E.
Said decals shall have written thereon "South River
Borough Parking Permit," together with the number of the decal, motor
vehicle registration number and the date issued and the date of expiration.
F.
The Borough Clerk shall make and keep a record of
all decals issued by him, including therein the number of the decal,
the date of issuance, the name of the person to whom issued, with
his address, the motor vehicle registration number and the make, model
and color of the motor vehicle for which issued.
Any person parking a motor vehicle with such
decal affixed thereto shall be presumed to have properly applied for
and received permission to park said motor vehicle in any such parking
area of the Borough of South River.
Further rules and regulations pertaining to
such parking areas and the parking of motor vehicles therein may be
made from time to time by ordinance of the Borough Council.
No person shall park or place any disabled vehicle
or permit any such disabled vehicle to remain in any such parking
area without the express permission of the police or the attendant
in charge of such parking area.
A.
Any person parking a vehicle in any other manner than
is required by this article, even though the vehicle bears a valid
decal, shall be subject to a fine not exceeding $2, and each day that
such violation occurs shall be a separate and distinct violation.
Payment of such fine may be made to the Court Violations Clerk of
the Borough Municipal Court upon a plea of guilty.
B.
In case of a violation of any other provision of this
article, the person so parking and the owner shall be liable to a
fine of not more than $25 or five days in the municipal jail, or both,
and each day the violation continues shall be a separate and distinct
violation.
C.
Any vehicle parked in any such parking area in violation
of this article, except a vehicle bearing a valid decal and parked
as now herein required, may be removed from the parking area on order
of any police officer, and the owner thereof shall pay the reasonable
cost of such removal and of storage, which may result from such removal
before being allowed to regain possession of the vehicle, and such
costs of removal and storage shall be in addition to any penalty or
fine hereinbefore provided.
This article shall not apply to any municipal
vehicles registered to the Borough of South River or to any vehicles
engaged in police work.
