As used in this article, the following terms
shall have the meanings indicated:
Food and beverage containers made entirely of aluminum.
Those containers of a metal-type can with tight-closing lid,
plastic-type can with tight-closing lid, plastic garbage bags sufficiently
strong for collection purposes that are properly tied off at the top,
but not including cardboard boxes.
The following designated recyclables generated within the
geographic boundaries of the Borough: newspapers, glass containers,
aluminum cans, corrugated cardboard from residential and commercial
sources, steel cans, plastic containers, mixed paper and textiles.
Branches, woody plants and other like vegetative materials
that do not exceed five inches in diameter and Christmas trees. "Brush"
does not include leaves and grass clippings.
Includes concrete, cement, plaster, stones, cinder blocks,
concrete blocks, plasterboard, plaster, wood, brick, soil and/or trees
for clearing and any other material common to the building trades
and which are accumulated from excavating or from construction, building,
demolishing or repairing any structure or from construction or repairing
any sidewalk, driveway or street or roadway. The term "building materials"
or "building debris" shall not be construed as garbage.
Twenty-gallon, plastic containers to be used by the residents
of the Borough to place plastic containers, glass containers, aluminum
cans and steel cans at the curb for collection by the Borough, or
such other container designated by the Borough for such use.
All recyclable materials that are designated by the County
of Middlesex, State of New Jersey and the Middlesex County District
Solid Waste Management Plan, as the same may be amended from time
to time, and any other material when so designated by the Borough
Administrator in accordance which the provisions of this article.
On the effective date of this article, "designated recyclables" are
newspaper, aluminum cans, glass containers, corrugated cardboard,
steel cans, plastic containers, mixed paper, textiles, grass clippings,
leaves, yard vegetation, motor oil, brush along with the following
mandatory source separated items as of December 1, 2007, shall be
considered "designated recycables."
For residential (including multifamily), commercial,
industrial and institutional, governments and office parks:
Masonry/paving material: asphalt, block, brick,
cinder and concrete.
Rechargeable batteries: Nickel Cadmium (Ni-Cd),
Nickel Metal Hydride (Ni-MH), Lithium Ion (Li-ion) and Small Sealed
Lead (Pb).
Tires: rubber-based scrap automotive, truck
and equipment tires.
White goods: washers, dryers, ranges, refrigerators,
air conditioners. Note: all devices that contain CFCs must be properly
evacuated by licensed individuals, and all CFCs recovered must be
sent to an EPA approved reclaimer.
For commercial, industrial and institutional,
governments and office parks:
Electronics: televisions, CPUs, monitors, laptops,
and mercury-containing devices.
Fluorescent bulbs: lamps that contain mercury.
Plastic film: stretch/shrink wrap, plastic shopping
bags only for warehouses, retail establishments and supermarkets with
25 or more employees.
Wood scrap: unfinished lumber from new construction
projects including pallets. Unfinished shall mean nonchemically treated
(not pressure treated, impregnated with preservatives, insecticides,
fungicides, creosote, or other chemicals, and not painted, resin-coated
or otherwise surface treated and not laminated or bonded; and not
similarly altered from its natural condition) only for new construction
sites.
Includes any office or kitchen waste, as well as refuse in
the nature of animal and vegetable matter of a similar nature, together
with paper or plastic bags and linings used to contain same.
All glass containers used for packaging food or beverages.
Includes all large appliances, television receivers, furniture,
bed springs, tires, large automobile parts and similar materials.
The residue from any manufacturing, commercial or retail
outlet which participates in all recycling programs instituted by
the Borough and which residue shall not exceed five approved containers
on any collection day nor include any recyclable materials.
Glossy inserts, magazines, telephone books, junk mail, colored
paper, computer paper, office paper, paperboard (chipboard and pressboard),
nonmetallic wrapping paper, soft cover books, hard cover books with
covers removed and fine paper.
A covered, eight-gallon container in which Borough residents
will place mixed paper at the curb for collection by the Borough,
or such other container designated by the Borough for such purpose.
Includes all individuals, partnerships, corporations, owners,
tenants, lessees, occupants, associations, organizations, residing
or owning, operating, managing, leasing or occupying any premises
or business, commercial or industrial use within the Borough of South
River. The word "person" shall include and be synonymous with the
word "resident."
Soda bottles made of PETE (SPI code No. 1) and milk, water
and laundry product bottles made of HDPE (SPI code No. 2).
Tin-plated, bimetal and other ferrous food and beverage containers.
A special bag to be provided by the Borough for the collection
of textiles, or such other container to be designated by the Borough
for such purpose.
Clean, dry clothing or other fabric measuring at least one
foot by one foot in size.
Includes all manner of refuse generally designated as paper,
cardboard, rags, glass, metal containers, ashes and all debris of
a similar nature that accumulates incidentally to the use and occupancy
of a residential unit.
Discarded petroleum-based or synthetic lubricating oil from
automobile and other engines.
All approved-type containers or plastic bags containing no
more than 50 pounds of waste material.
A.Â
Collection and ownership of designated recyclables.
No person shall dispose of designated recyclables with regular trash.
Designated recyclables must be recycled through a program established
by the Borough of South River for resale by said Borough for recycling
purposes or by private collection when permitted. From the time that
any person places designated recyclables at the curb for collection,
the designated recyclables shall become the property of the Borough
of South River. It shall be a violation of this article for any person
other than the Borough of South River, its agents, servants, employees
or duly authorized contractors to tamper with or remove such materials,
except as otherwise set forth herein. Each violation of this section
shall constitute a separate and distinct offense.
B.Â
Rules and regulations to be promulgated. The Borough
Administrator is hereby authorized to establish and promulgate rules
and regulations, and amendments thereto, governing the collection
of all garbage and trash within the Borough, including but not limited
to the manner, days and times of such collections and the bundling,
handling, location and time of placement of all garbage and trash,
including all recyclable materials and vegetative waste. All rules
and regulations shall be published at least once in the official newspaper
of the municipality and shall be posted in such place or places designated
by the Mayor and Council for the posting of public notices within
the Borough. No rule or regulation promulgated pursuant to this section
shall become effective until 30 days following the first date of publication
and posting, as provided herein. A complete and current copy of all
rules and regulations promulgated pursuant to this article shall be
distributed to all residents at least twice yearly.

Mandatory compliance. On and after the date fixed
in the regulations as promulgated by the Borough Administrator, it
shall be mandatory for all persons to separate designated recyclables
from all other solid waste generated or disposed of by persons subject
to this article and to further separate all recyclable materials required
under the program, rules and regulations established thereunder or
by this article.
D.Â
Collection by others. The Borough Council, may, in
accordance with its statutory authority, negotiate and enter into
franchises or agreements with qualified persons to make the collections
of designated recyclables and for the sale or disposition of designated
recyclables for the resultant benefit of the Borough.
E.Â
Additional collection requirements.
(1)Â
No person shall dispose of grass clippings, leaves,
branches, brush and other yard vegetation with regular trash. Collection
shall be made on designated and scheduled days for collection or by
appointment.
(2)Â
No garbage shall be placed for collection in paper
bags, cardboard boxes or corrugated receptacles.
(3)Â
No person shall at any time place curbside more than
the permitted number of approved containers, as set forth in the rules
and regulations promulgated pursuant to this article, for collection
thereof.
(4)Â
No person shall place at curbside any garbage container
earlier than one hour before sunset the night before a scheduled collection,
nor later than the normal hour of collection on the regularly scheduled
day of such collection. No call-backs for a regularly scheduled collection
shall be permitted.

No person shall dispose of designated recyclables
with regular trash. Collection and/or disposal of designated recyclables
shall be in accordance with rules and regulations promulgated pursuant
to this article.
F.Â
Collection and ownership of designated recyclables.
From the time that any person places any designated recyclables at
the curb for collection or in any Borough receptacle designated for
the collection of any designated recyclables, said designated recyclables
shall become the property of the Borough of South River. It shall
be a violation of this article for any person, other than the Borough
of South River, its agents, servants, employees or duly authorized
contractors to tamper with or remove such materials. Each violation
of this section shall constitute a separate and distinct offense.
The following refuse shall be considered not
acceptable for collection by the Department of Public Works:
A.Â
Industrial/commercial waste materials or substances
such as poisons, acids, caustics, noxious chemicals, infected materials,
explosives, ammunitions, motor oil or any other materials likely to
cause injury to persons employed by the Department of Public Works
or to equipment used in the collection system.
B.Â
Materials in an amount greater than that permitted
by this article resulting from the demolition, repair of construction
of buildings or structures such as earth, plaster and/or mortar.
C.Â
Vegetative waste, including but not limited to grass
clippings, leaves, branches, brush and other yard vegetation.
D.Â
Any material which cannot be disposed of in accordance
with the standards and regulations set forth or prescribed by the
New Jersey Department of Environmental Protection or the South River
Board of Health for disposal of waste materials in the sanitary landfill
site.

A.Â
Placement of bulk items for collection, residential,
non-rental properties.
(1)Â
All
residential properties requesting collection of bulk items must adhere
to the policy established by the Director of the Department of Public
Works.
(2)Â
Residents
must schedule an appointment with the Public Works Department for
collection of heavy trash and bulk items.
(3)Â
Bulk
items shall be placed at the curb for collection the evening before
the scheduled date of pick up.
(4)Â
Residents
are limited to four bulk item collections per calendar year.
(5)Â
Disposal
of refrigerators and freezers must comply with federal regulations
regarding chlorofluorocarbon removal. All doors shall be removed from
appliances scheduled for bulk collection.
B.Â
Placement of bulk items for collection, commercial
and rental properties.
(1)Â
No bulk waste will be collected from any residential rental properties, commercial, office or other business establishments unless specifically permitted pursuant to Subsection B(3).
(2)Â
Removal
and disposal of bulk waste for rental properties shall be the sole
responsibility of the commercial/rental property owner.

No ragpicker, scavenger or any unauthorized
person shall break into, untie or otherwise unbundle any container,
bundle or pack of papers, ashes, refuse, garbage or trash that has
been placed outside for the collection thereof.
The Department of Public Works shall not be
responsible for the collection of garbage, trash, debris, etc., from
a garden apartment complex, townhouse complexes or such other areas
or locations similarly described or defined.
The provisions of this article shall be enforced
by the Code Enforcement Officer of the Borough of South River, the
Director of the Department of Public Works and the South River Police
Department.
Any person who violates any provision of this article shall, upon conviction thereof, be punished as provided in Chapter 1, Article I, General Penalty. Each violation of any of the provisions of this article and each day that such violation continues shall be deemed and taken to be a separate and distinct offense.
