A. 
A Board of Recreation Commissioners is hereby established in the Borough.
B. 
The Board of Recreation Commissioners shall consist of three members appointed by the Mayor. The Board members shall be members of the Council of the Borough of Spring Lake.

C. 
The three members of the Board of Recreation Commissioners shall initially be appointed for terms of one and two years. Thereafter, all appointments shall be for a term of three years. Vacancies in the term of any Commissioner shall be filled for the unexpired term only. Commissioners shall serve until their respective successors are appointed and qualified. Commissioners shall receive no compensation for their services.

The Board of Recreation Commissioners shall have such powers and the Board shall receive such financial aid from the Borough as shall be authorized by the provisions of N.J.S.A. 40:12-1 et seq. or as authorized by the Mayor and Council in accordance with other applicable law.

In accordance with the N.J.S.A. 40:12-5, as amended from time to time, the Board of Recreation Commissioners may charge and collect reasonable fees from participants or spectators or from both participants and spectators with respect to recreational activities. The amounts charged and collected shall be used for the expenses of the Board. All monies received by the Board shall be paid over to the Chief Financial Officer and the same duly deposited in a special fund, which special fund shall be under the control of the Board of Recreation Commissioners.
Any person violating any provisions of this article or violating any of the rules, regulations and bylaws of the Board of Recreation Commissioners shall, upon conviction, be liable to the penalty provided in Chapter 1, Article II, General Penalty.
