[HISTORY: Adopted by the Mayor and Council

The Mayor or, in the absence, disability or
death of the Mayor, the acting Mayor, as provided for by statute,
may issue without the consent, consultation or advice of the Borough
Council one or more of the following proclamations:
A.
To declare a curfew during specified hours covering
all or a portion of the Borough thereby requiring all persons to remove
themselves at once from the public streets, sidewalks, parks and other
public places, except that such a curfew shall exempt all necessary
medical personnel, police officers, firefighters, utility personnel
and such other persons as may be required to maintain essential services
and to maintain peace and good order.
B.
To declare a curfew during specified hours prohibiting
the use of the public streets in all or a portion of the Borough by
any person operating a motor vehicle of any description except the
use of such motor vehicles as may be authorized by the Mayor or by
such other officer authorized to act in his behalf.
C.
To close during the emergency period, as contemplated
herein, all motor vehicle service stations and all places licensed
to sell and dispense alcoholic beverages within the Borough.
D.
To prohibit any person during the emergency, as contemplated
herein, from carrying, holding or possessing any firearms, explosives
of any kind, or any rock, bottle, club or other object capable of
being used as a weapon except that this prohibition shall not apply
to law enforcement officers nor to other authorized personnel engaged
in maintaining essential services and in preserving peace and good
order.
E.
To issue all orders deemed necessary to maintain peace
and good order and to suppress all riots and tumultuous assemblies
within the Borough; and further, to issue all orders deemed necessary
or advisable to protect and to preserve the lives and properties of
the inhabitants of the Borough.
The emergency proclamations provided herein
shall terminate 48 hours from the issuance thereof unless either terminated
sooner by a proclamation stating that the emergency has ceased or
extended for a reasonable period of time not in excess of 48 hours.
The emergency proclamations shall become effective
upon issuance thereof by the Mayor or acting Mayor, and the same shall
be disseminated to the public by news media, postings in conspicuous
places within the Borough and, whenever feasible, by public-address
systems within the Borough.
This chapter is intended to augment any other
statute or ordinance covering the same or related subject matter.
