A. 
Dogs shall be licensed and shall bear evidence of such license at all times in accordance with the laws of the State of New Jersey.
B. 
The annual fee for each license issued shall be as follows:
(1) 
Annual License fee for an unspayed or nonneutered (nonaltered) dog: $15.00
(2) 
Annual License fee for a spayed or neutered (altered) dog: $12.00
C. 
The foregoing license fees shall include the charges for the dog registration tag fee, the surcharge of $0.20 for the Pilot Clinic Fund of the State of New Jersey and, in the case of an unspayed or nonneutered (nonaltered) dog, the charge of $3 for the Animal Control Fund of the State of New Jersey.
D. 
The fee for the replacement of lost dog registration tag is $3.50.
E. 
Late fee: Any license purchased after February 28th shall be assessed an additional late fee of $5.00.

The annual dog license shall be issued for the period commencing on January 1 of each year and terminating December 31 of the year.
A dog owner shall present to the Borough either a statement from a licensed veterinarian or an affidavit of the owner that the dog to be licensed has been spayed or neutered (or altered) in order to be exempt from the fee of $3 for the Animal Population Control Fund of the State of New Jersey.
No license to own, keep or harbor a dog in the Borough shall be issued to or in the name of a minor.
A. 
Running at large prohibited. No dog shall run at large at any time within the limits of the Borough and no person owning, keeping or harboring any dog shall suffer or permit it to be on the bathing areas of the Borough at any time or under any circumstances, except as permitted in Subsection B.
B. 
Dog to be on leash. Any dog off the premises of the person owning, keeping or harboring it shall be accompanied by a person who is capable of controlling it and who has the dog securely confined and controlled by an adequate leash not more than six feet long.
No person owning, keeping or harboring a dog shall permit or suffer it to do any injury, or to do any damage to any lawn, shrubbery, flowers, grounds or property of persons other than the owner or person having the care, custody or control of such dog.
No person shall keep, harbor or maintain any dog which habitually barks or cries so as to disturb the public peace.

All dogs shall be securely confined and controlled by an adequate leash and all persons either shall curb their dogs when in these areas or properly clean up after the dogs.
A. 
Dogs shall not be allowed on the boardwalk at any time.
B. 
Dogs shall not be allowed on the beach areas in the Borough commencing on May 15 of each year and terminating on September 30 of each year except in a fenced area erected by the Department of Public Works north of Pitney Avenue ("Dog Beach"). Dogs are permitted in the Dog Beach area from sunrise to 9:00 A.M., from 6:00 P.M. to sunset and may be unleashed.
C. 
Public parks.
(1) 
Dogs shall not be allowed in the following public parks of the Borough:
(a) 
Divine Park.
(b) 
Potter Park.
(c) 
Marucci Park.
(d) 
Pazlensa Park.
(2) 
The only exceptions to having dogs in the above parks shall be for the purpose of crossing the park areas on the sidewalks or bridges or of walking with the dogs along the perimeters of the parks on the sidewalks.
D. 
School areas. Dogs shall not be allowed to cross over school areas.
(1) 
Property owned and operated by the Spring Lake Board of Education, namely, H.W. Mountz School and adjoining school grounds.
(2) 
Property used by St. Catharine's Grammar School which is bounded on the east by Second Avenue, on the south by Pennsylvania Avenue, on the west by Third Avenue and on the north by Salem Avenue.
The Mayor and Council shall have the power to enter into a contract with one or more persons for the exercise of the duty of Animal Control Officer to enforce the provisions of this article. In the absence of Animal Control Officer, the functions, obligations and duties described in this article shall be carried out by the Police Department.
Impoundment and redemption of dogs seized according to law shall be as provided in N.J.S.A. 4:19-15.16.

The provisions of this article shall be in addition to the provisions of any and all laws of the State of New Jersey relating to rabies and control of dogs.
A. 
No person owning, walking or otherwise having custody or possession of any dog shall cause, suffer or permit such dog to soil, defile, defecate on, or commit any nuisance on any curb, street, sidewalk, park, playground, school land, or upon any private property without the permission of the owner of the private property obtained in the last instance.
B. 
Any person owning, walking or otherwise having custody or possession of any dog which soils, defecates on, or commits any nuisance on any curb, street, sidewalk, park, playground, school land, or upon any private property without the permission of the owner of the private property obtained in the last instance shall immediately remove all feces deposited by any such dog, which removal shall be in a sanitary manner by shovel or placed in a container and promptly disposed of in a sanitary manner.

Notwithstanding the provisions of §§ 107-5 through 107-8 above, dogs which are not leashed may be used within the Borough of Spring Lake in conducting activities under the authority of any federal or state permit issued by either or both agencies in connection with the humane treatment and/or control of wildlife on said waters. Said dogs shall, at all times, be under the strict control and supervision of the individual responsible for conducting the activities permitted under the terms and provisions of the federal or state permit.
Prohibited. No person, firm or corporation shall, at any time, maintain a kennel or similar structure for the purpose of boarding, raising, training or otherwise dealing in dogs. The boarding, training or sale of dogs for compensation within the limits of the Borough is hereby prohibited.
With the exception of domestic dogs or cats maintained as pets, no horse, sheep, swine, goat or cattle or geese, ducks or other fowl or any other animal shall be permitted within the Borough, under the penalty, upon conviction, established in § 107-16.
Except as provided in N.J.S.A. 4:19-15.1 et seq., any person who shall violate any provisions of this article shall, upon conviction thereof, be liable to the penalties as provided in Chapter 1, Article I, General Penalty, in the discretion of the Judge of the Municipal Court before whom the complaint is heard.
