[Adopted by Ord. No. 1-1984 (§ 10-1 of the Revised General Ordinances)]
A certain document, three copies of which are on file in the office of the Clerk of the Borough being marked and designated as the "Basic Property Maintenance Code, Second Edition, 1981", further as amended and supplemented, as published by Building Officials and Code Administrators (BOCA) International, Inc., and as the same may be revised, amended and supplemented, be and is hereby adopted as the Property Maintenance Code of the Borough of Spring Lake, in the County of Monmouth and State of New Jersey for the control of buildings and structures as herein provided; and each and all of the regulations of the Basic Property Maintenance Code, Second Edition, 1981 are hereby referred to, adopted, and made a part thereof, as if fully set out in this article.

The BOCA Basic Property Maintenance Code, Second Edition, 1981 is hereby amended as follows:
A. 
Section PM-100.1, Title, is amended to read as follows: These regulations shall be known as the Property Maintenance Code of the Borough of Spring Lake hereinafter referred to as the property maintenance code or "this code."
B. 
Section PM-109.2, Penalty, is amended to read as follows Any person firm or corporation violating any of the provisions of this code shall, upon conviction thereof, be subject to the penalties in Chapter 1, Article II, General Penalty of the Code of the Borough of Spring Lake, at the discretion of the court having jurisdiction in this matter. Each day that a violations continues after due notice has been served, in accordance with the terms and provisions hereof, shall be deemed a separate offense.
C. 
Section PM-111.4, Restraining Actions, is amended to read as follows: Anyone affected by any such order shall within 20 days after service of such order apply to a court of record for an order restraining the Code Enforcement Officer from razing and removing such structure or parts thereof. The court shall determine whether the order of the Code Enforcement Officer is reasonable, and if found reasonable, the court shall dissolve the restraining order and if found not reasonable, the court shall continue the restraining order or modify it as the circumstances may require.
