The owners or tenants of lands abutting or bordering on the sidewalks of public streets or avenues within the Borough shall remove or cause to be removed any vegetation, brush, tree growth, grass, weeds or similar impediments to travel and safety where the same is growing in, on or over the sidewalk area or where the growth of such vegetation, brush, tree growth, grass, weeds or similar impediments obstructs in any manner the full width of the sidewalk area.
It shall be unlawful for any person to deposit vegetation, brush, tree growth, grass, weeds or other impediments or cause the same to be deposited between the curblines of any street within the Borough for authorized items except on designated days.
The owner or owners, tenant or tenants of lands abutting or bordering upon the sidewalks and gutters in the public streets, avenues and highways of the Borough shall remove all grass, weeds, vegetation, brush, tree growth, or similar impediments on such sidewalk within three days after written notice to remove the same.
The written notice hereinbefore provided directing the removal of the grass, weeds, vegetation, brush, tree growth or similar impediments herein mentioned shall be prepared by the Code Enforcement Officer over his signature and shall identify the lands abutting or bordering upon the sidewalks and curbs as hereinbefore provided, and shall contain a short statement relating in detail and identifying the material which is directed to be removed pursuant to this article. The notice shall also contain a statement that the owner or owners of the land in question may be assessed the cost of the removal of the impediments if they, the owners, neglect so to do within the time limit in the notice. The notice shall also contain a statement that the violation of the terms of this article is punishable by fine or imprisonment, or both.
The notice may be served upon the owner or owners resident in the Borough in person, or by leaving the same at their house or place of residence with a member of their family above the age of 14 years. In case any such owner shall not reside in the Borough of Spring Lake, such notice may be served personally or mailed to the owners' last known post office address, or it may be served upon the occupant of the property, or upon the agent of the owner in charge thereof. In case the owner of any such property is unknown or service for any reason cannot be made as above directed, notice thereof shall be published at least once in a newspaper circulating in the Borough of Spring Lake and a copy of the notice shall be posted in a conspicuous place upon the premises.
If the owner or owners, tenant or tenants, of lands abutting or bordering upon the sidewalks and curbs in the public streets, avenues and highways of the Borough neglect or refuse to remove weeds and similar impediments therefrom within three days after the service of written notice to remove the same as hereinbefore provided, such impediments may be removed by the Street Department of the Borough by or under the direction of the Borough Superintendent, and, after such removal, the Borough Superintendent shall certify the cost thereof to the Mayor and Council of the Borough, which shall examine the certificate and, if found correct, shall cause the cost as shown thereon to be charged against the lands abutting or bordering on the sidewalks and gutters in the public streets, avenues and highways of the Borough. The amount so charged shall forthwith become a lien upon such land and shall be added and become and form a part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as taxes and shall be collected and enforced by the same officers and in the same manner as taxes.
Every person, firm, association, organization or corporation violating any provisions of this article shall, upon conviction, be liable to the penalty stated in Chapter 1, Article II, General Penalty.
