GENERAL REFERENCES

This chapter shall be known as "Local Law 1/2001, A Local Law Authorizing the Issuance of Appearance Tickets by Public Servants of the Village of Spencerport."

The purpose of this chapter is to authorize law enforcement officers and Village of Spencerport public servants to issue and serve appearance tickets in connection with violations of state statutes, local laws, ordinances or rules and regulations of the Village which the public servants are authorized or required to enforce.

Law enforcement agencies, including, but not limited to, the New York State Police, Monroe County Sheriff and Town of Ogden Police Department, are authorized to enforce the provisions of and issue and serve appearance tickets with respect to violations of Chapter 310, Vehicles and Traffic, of this Code, including, but not limited to, all provisions relating to parking, standing and removal and impounding of vehicles.
The following public servants of the Village of Spencerport are hereby authorized to issue and serve an appearance ticket or parking violations summons with respect to violations of a state statute, a local law, ordinance, rule or regulation of the Village of Spencerport that such public servants are, respectively, required or authorized to enforce:
A. 
Building Inspector: building, zoning, planning matters.
B. 
Code Enforcement Officer: all local laws and ordinances of the Village of Spencerport.
C. 
Superintendent of Highways and working foreman for the Department of Public Works: parking laws and ordinances, including parking on streets, highways and Village-owned and leased parking lots.

An appearance ticket, other than for a parking violation, shall be served personally.

Jurisdiction over parking violations may be by appearance ticket or parking violations summons, which shall be issued by the law enforcement agency or public servants named above.

Nothing contained herein shall be construed to limit the authority of law enforcement agencies to enforce any law, statute, rule or ordinance under any other enabling legislation.
