A. The "Royal Oak City Market" is herein defined to be the
County- and City-owned and regulated marketplace, together with buildings
thereon, designed for the sale of farm products and the accommodation of producers,
and hereinafter designated as the "Public Market."
B. The general administration of said market shall be under
a joint market committee of the County and City. The City members shall consist
of the City Manager and two City Commissioners, designated by the City Commission.
Said Committee is charged with the enforcement of this chapter and is hereby
empowered to make or amend from time to time such additional market rules
and regulations as may be deemed necessary for the proper management and control
of said market, subject to the provisions of this chapter, and subject to
the provisions of any rules and regulations made by the Board of Supervisors
of Oakland County governing the conduct of said market.

The word "producer" is herein defined to be any person or persons who
are actually engaged in the business of producing farm products. Producers
shall be allowed to sell on the Public Market wholesome, fresh, sound, canned,
dried, preserved or prepared food products either raised by the producer or
processed, manufactured or otherwise prepared by him in whole or chiefly from
products raised by him, but shall not be permitted to sell processed or manufactured
food or other articles, the major ingredients of which have been purchased
or otherwise acquired for such processing or manufacture. Producers shall
also be allowed to sell certain other products of their farm, greenhouse,
apiary, rabbit hutch, such as live or dressed poultry and rabbits, and flowers,
plants, nuts, herbs, shrubbery, Christmas trees and other trees; provided
that in so doing they comply with all the rules and regulations in force in
said City; and provided further that all live poultry and rabbits brought
to the market shall be confined in suitable crates, and that dressed poultry
and rabbits shall be kept in iced containers covered with glass. The sale
of all meat or meat products except those herein mentioned is hereby prohibited,
and the sale of all baked goods shall be limited to those under conditions
prescribed by the Market Master.

Producers must keep a price list of all items offered for sale, evidenced
by legible price tags conspicuously placed either on the articles offered
for sale, or otherwise posted, to inform prospective customers of such prices.
The indicated price must be maintained until prices are changed and tagged
or posted accordingly.
Market Masters and their duly authorized assistants, acting themselves,
shall have the authority to direct the arrangement of all vehicles on the
market grounds, and persons in charge of such vehicles shall conform to the
directions so given. No person on the Public Market shall refuse to comply
with the direction of or interfere with the Market Masters or their assistants
in carrying out the provisions of these rules and regulations, nor shall any
such person seek to evade or refuse payment of the proper market fees when
called upon to do so.

Stalls at the Royal Oak City Market may be rented by the year, the season,
the month or the day, in accordance with the schedule of fees adopted by the
Market Committee and approved by the City Commission. Such schedule of fees
shall be kept posted in the Market Building. In case of any change in the
schedule of prices, notice of such change shall be posted in the Market Building
at least 15 days before said change takes effect.

The Market will open at 7:30 a.m. and close at 1:00 p.m. except that
on Saturdays it will open at 10:30 a.m. and close at 5:00 p.m. The times for
opening and closing may be changed by the Market Master as conditions may
arise to make a better market for producers and buyers. The Market Master
may set the time that rented stalls must be occupied by the renter, and if
said stall is not occupied at the time so set the Market Master may rent it
for the day.

No persons renting a stall on the Public Market shall sell, sublet or
assign such space or any privileges pertaining thereto. Exchanges of rented
stalls may be made with the price approval of the Market Master.

Any producer selling products or renting a stall space on either a daily,
annual or six-month basis on the said Public Market shall be required to have
a license therefor. Application for such license shall be made to the Market
Master and shall contain under oath a statement by the producer of his name,
address, the character, nature and extent of his business, the kind and amount
of the products produced by him which he proposes to sell on the public market,
and such other data as may be deemed necessary for the protection of the public
health and for the proper administration of the Public Market. The fee for
said license shall be $1 which shall be paid to the City Treasurer. Upon payment
of the fee and the filing of the application approved by the Market Master,
the City Clerk shall issue to the applicant a license, together with a metal
license plate. Either this plate or an acceptable sign shall be conspicuously
displayed at all times by the producers.
No person shall deposit vegetable refuse or other garbage, broken crates,
boxes, barrels or pieces thereof, paper, or other rubbish on the Public Market.
No person shall distribute, scatter about or post on the Public Market
any advertising pamphlet, car, handbill or other printed matter, nor shall
any person beg, loiter, solicit patronage for any business, or sell or attempt
to sell, display or demonstrate any goods, merchandise, real estate, animals,
vehicles or other materials or things whatsoever on the Public Market, except
as herein provided.

Any producer buying and selling farm produce will not be permitted to
sell any of such products on the Market.

Attempts to establish or the establishment of abnormal or artificial
prices for products sold on the Public Market, by agreement between sellers
or between buyers, or by other unfair and irregular means; repeated verified
complaints against any producer who sells on the Public Market giving reasonably
conclusive evidence that such person has practiced deception in his or her
dealings on the Market by displaying or selling his or her produce so packed
and faced as to misrepresent the average quality or condition of the produce
of the package, or by knowingly giving false information regarding the origin,
variety, quality, condition or value of the products which he or she sells,
or by similar sharp practices shall, in addition to any other penalties which
may be inflicted, be cause for the Market Master to bar such guilty person
from the privileges and grounds of the Public Market for such period of time
as may be deemed advisable by him. Any such action shall be preceded by a
hearing at which the person involved shall have a chance to fully present
his defense in any charges made against him. Any person who is barred from
the Public Market by order of the Market Master for violation of these rules
shall have the right to appeal for reinstatement to the joint Market Committee.
Such appeal shall be in writing and addressed to the Chairman of the Board
of County Auditors, who shall designate a day for the hearing of said appeal
within 10 days from the receipt of said request and shall notify the appellant
of the time and place of said hearing.
Any person barred from the Public Market privileges and grounds for
a specified period of time, not exceeding one year, under the provisions of
these rules he or she shall not, during such time, sell or buy through himself
or any other person, on the Public Market, nor shall he or she, his or her
vehicle enter upon the Public Market property during the market hours. No
other person shall sell on the Public Market products belonging to any person
barred from the Market.

Anyone found guilty of violating any of the provisions of this chapter
shall be fined not to exceed $100 and costs, or imprisoned in the Oakland
County Jail or Royal Oak City Prison not to exceed 30 days, or both such fine
and imprisonment in the discretion of the court.
