All terms and conditions of the bulk service
municipal agreement between Girard Township, Lake City Borough and
JaLee, LLC (the "agreement") are hereby incorporated by reference
into this article.
The agreement shall continue in effect until
terminated upon terms and conditions as set forth in the agreement.
The purpose and objective of the agreement is
for Lake City Borough to provide bulk water services to Girard Township,
which will permit JaLee, LLC to receive water services.
Girard Township has, pursuant to the agreement,
granted to Lake City Borough the power to act as sole and exclusive
billing and collection agent for all water rentals owed by JaLee,
LLC to Girard Township pursuant to terms as set forth in the agreement.
Girard Township hereby requires JaLee, LLC,
its successors or assigns, to pay such water rates and charges as
are necessary to reimburse Girard Township for the cost in invoices
extended by Lake City Borough to Girard Township and to comply with
all rules, regulations, ordinances and laws of Girard Township and
Lake City Borough, including but not limited to the Lake City Borough
Code, regarding water.
The agreement is financed by the obligations
of JaLee, LLC pursuant to the terms of the agreement.
The agreement shall be implemented by Girard
Township, JaLee, LLC, and Lake City Borough.
The water line and rights-of-way shall be acquired,
managed, maintained, repaired and disposed of pursuant to the terms
of the agreement.
